    Yes, you can use MCOL to sue anyone in England and Wales.

    But you must have an address in England for them to use to serve documents to.

    You just need an address (you don't have to live there).

    My original answer was intended to help jagnew's query about having an address in Scotland.

    I did not deliberately diss the Welsh.

    Of course if everyone did as grayme-m and get the info from the horses mouth instead of relying on this forum then there would be no chance of these allegations of Robinsonism at folk just trying to help someone out.

    Thanks Brenda, I have just finished writing one last letter (LBA) which I will send Registered post tomorrow. They have 7 days from receipt to send me a cheque for my 1st 4 months cashback. Failing that I will spend £44 raising a claim in the scottish courts.
    I expect to re-coup this fully as TMO have already admitted my claim was successful and I have copies of all paperwork/e-mails etc. The only option for them is to pay up now and save themselves more costs.

    Also after reading the posts about claims of missing paperwork, I have decided to have my next claim for cashback, witnessed by a third party with a statement showing what was placed into the envelope, maybe even a photo taken of all paperwork sent.

    It is sad that this is what it has come to but some are sure that ALL relevent paperwork was sent and TMO still dispute it.

    The Scottish Courts won't be able to help you recover any money from anywhere outside Scotland.

    Mmmmm...thanks Quentin, I seem to remember something like that when I was going after my English Bank charges but as they paid up, I didn't need to follow it through.

    If I remember correctly I was going to have to use the English court just over the scottish border for that one. Can't remember how I was supposed to get around the need for an English address though:confused:
