    From what others have said on here you should continue with the claim for the whole lot.

    ETA: PJB, it was rightly posted following this post that you should be careful of advice posted on an anonymous message board.

    Clearly the fact it was addressed personally to you following only myself responding to your query was in no way intended as an attempt to put me down. :rolleyes:

    It could have come at any point before now in any of the three TMO threads...

    That's good common sense advice there from Brenda. Obviously contributors to this forum are anonymous and in most instances are offering their opinions and past experiences dealing with TMO.

    That said, in my view.....
    I would continue to pursue your claim. I'm assuming that you've made a claim via Money Claim Online, therefore the costs that you are referring to are the £30 it costs to make a claim?

    For a start, TMO never sent you a copy of their T&Cs with your order, which they obviously should have. I would think that helps your argument, if only slightly. In hindsight, it would've been a good idea for you to print a copy of their T&Cs from the link they gave you at the time, because as you found out subsequently, these often change, but it is the T&Cs in force when you order the phone that apply.
    In your position, I would argue that if you had been sent a copy of TMO's T&Cs with your phone, that you would've understood that you needed to send the bills in within 21 days of the date of the bill. Instead, you contacted them by phone and were told that you had to send the bills within 21 days of receiving the 4th bill. Even after this mix up, your claim was only 1 day late which hardly makes a difference in the 'real' world. Any decent company should've taken this on board when you first asked them to review the reason for rejecting your cash back claim, and paid you the cash back.

    Instead, TMO have tried to avoid paying this to you by tempting you with partial offers, such as paying you subsequent cash back claims. I believe that the very fact they have even entertained the idea of offering you some of the cash back means that they have a good idea that they would lose if you claimed against them.

    So I imagine you had no choice but to pursue this with a small claims action, incurring the £30 cost, when TMO suddenly decided to offer to pay your cash back but not the cost of the action.

    I've no legal qualifications whatsoever, and you are welcome to pay and get proper legal advice as Brenda suggests. But in my experience and reading this thread over the past few months, provided you have tried your best to comply with the T&Cs and have acted in good faith, you have a good chance of winning your claim in full. All the best.

    What is TMO's policy on RM's strike actions which can add severe delays to bills sent to us by mobile phone providers and us sending the bills to TMO?

    I've sent a claim to TMO for my wife on 26th Sep and so far have not received a confirmation of receipt from TMO. Royal Mail's webiste is not getting updated due to strike action and I am really in dark here as to what's happenening.

    I am also yet to receive last month's bill from my provider and if doesn't get delivered in time, I would not be able to send it to TMO within 21 days... Could TMO (forumqueries guys) or someone who has experienced this help me here?

    I would get gutted if I lose any of these 2 claims (one being the first one). I expect TMO to be reasonable with their terms to their customers here...

    Does anyone know exactly when Mobile Outlet started re-directing post from Shipley to Bradford North?

    I have been in continuous debate with them over their rejection on my 4th claim - posted 20 July. Royal Mail showed delivery to Shipley on 30 July(!), but no EPOD is available on line. Nothing happened for another 6 weeks, then in early September I received a rejection letter stating that my claim was late! I provided the Royal Mail tracking number but have so far heard nothing back from them.

    A friend of mine posted his claim to Mobile Outlet on 24 July, and his tracking showed delivery to Bradford North on 27 July, with a scanned signature (albeit totally illegible!). His claim was successful.

    Of course I am going to keep pursuing this, but does anyone know the deal of Shipley vs Bradford North? Should anything have been delivered to Shipley at all around that time?
  • Hi all. Your opinion on the following would be very useful.

    I received my 7th bill dated 17th August (I made a copy) and sent it by special delivery on 6 September. It was signed for on 7th September (am) and I have a copy of the electronic proof of delivery.

    I have just received a letter saying that "the 7th bill was received after the 21 day timescale......."

    Actually the t+cs state "....you will need to forward bills .........within 21 days of the issue date...... "

    I am pretty sure that I forwarded the bills within 20 days and they were received within 21 days but I am curious about what the rest of you think. Am I wrong?? I'm a mathematician curiously enough......

    I'd say (;)) as you did, you sent it on day 20 and they received it on day 21.

    I'm guessing that you used the worthless recorded delivery to send your claim?

    In order to get a response from "forumqueries" you need to send them a message, have you done this?
    grayme-m has experience of this, maybe he would be good enough to tell you how he got The Mobile Outlet to accept his late claim due to the bill coming late.

    It matters not when they started re-directing their mail. Why are you debating? Take action.

    What delivery method did you use?
    The "Worth every penny" Special delivery:), or "Throw your money away" Recorded delivery :mad: ?
