I admit I wouldn't know what do in your situation. I would hazard a guess that it was a geniune mistake (that they wrote out the cheque out incorrectly), but I certainly wouldn't put it past TMO, in this situation, to subsequently ignore that fact and then claim that they they have paid up when challenged, as a means of not paying/delaying payment of cashback.
Yes, this is what I think happened, probably a 'genuine' error but I feel TMO have proverbially rubbed their hands together with glee and the oportunity to delay payment further (it was 60 days been them receiving my 1st cashback claim and me receiving the duff cheque) plus...I would hope that the onus is on TMO to ensure that you receive a replacement cheque in a reasonable period of time. Not sure what would be classed as reasonable, but surely no longer that 28 days.
...it's definitely exceeded 28 days since I began notifying them of their cheque error and asking them to rectify their error. I waited from 6th August until 21st September (with the 6 pleas for a proper cheque between) before I submitted the claim online, (that's 46 days) and during these 46 days I received no reponse or acknowledgement about it, no 'we're processing it', nothing.
And now (Saturday 29th September I received my copy of their 'defence') they're replying to the court saying they have already sent payment. No, actually you haven't!! I've still not got a replacement cheque!! And now there really is a postal strike!!So carry on with your claim via MoneyClaim online, it is outstanding claim against them so they still need to send you another cheque. I'd be tempted to enfore the judgement with a warrant as it sounds like they're giving you the run-around.
It definitely feels like the run-around and I hope the courts see their actions as the breech of contract I'm claiming for!0 -

TMO making a genuine mistake when writing out a cheque...I don't think so...I'm sure I have seen other posts about errors on cheques...0 -

to claim the second half of your cashback entitlement, foreward us your 11 and 12 month bill, again this must be with 21 days from the date shown on each of these bills. :mad: . i am new to this site please help me . my claim was for £ 180.

Seems like you had exactly the same problem as me. Don't let The Mobile Outlet (TMO) get away with it!

To summarise, I managed to take TMO to court and got the whole of my cash back (£185) paid.

i have just received a casback refusal from the mobileoutlet saying that i did not send my 10 and 11 bill together within 21 days. they said i only sent my 10t bill. i sent both bills in the same envelope recorded delivery checked by my partner before sending but no photographic evidence. do they do this regulary is it worth claiming in court.

I need the T&C of Mobile outlet for the month of April/May 2007. I took the contract in May 2007 and send my fourth bill including all first to four bills, but sent the Print out as my T Mobile account is Paperless and when i received the phone didnt recieved that Bloody dispatch note or voucher to claim......then i went same day to india for 4 months when i came back sent the four bills two original and two online prints.......i spoke to customer services from india they said just sent the bills and we will pay the cash back.......when i called after sending bills....did you received it .....they rudely said....we cant confirm anything......what the f***......this is 21st century and western FULLY DEVELOPED courty.....govt or FSA should not allow all this dorgy people to establish the company.....where the hell is LAW and REGULATION.........i am so shatered when they said they cant pay me my remaining bills as well.........i mean cash back.....i am devistated as INTERNATION PERSON......dont understand much.......but i am so shocked.....as in DEVELOPED NATION AND NON CURRUPT COUNTRY PEOPLE STILL DO CHEATING HERE IN UK.....thats just more shokcing than loosing money..........CAN I GET THE T&C as i dont have and they have changed it on there website.......so i can knock the doors of LEGAL SYSTEM IN COURT........and hope to get justice from there...........also is there any way to close the contract with T Mobile........
