They are still committing a criminal act, as they are refusing to accept that they have bill 4, anyway if i get my cheque in the next day or 2, i will let it go this time.

You can't prove that they have bill 4, I imagine a company making a false claim like this would shred it? You can prove that it was received(In a way that a court would be satisfied with).
I am in no way saying The Mobile Outlet would commit such an act.:cool:

I don't know whether you are new to forums(fora?), but it is always advisable to read the thread from the start to see if the answer you ask has been answered before. This prevents the thread getting seriously long with the same questions and answers trotted out time after time.:)

Unless I've missed something I haven't found any reference to pooling claims/making separate claims through the ssc, but the thread is already "seriously long" so I wouldn't be surprised if I've missed something.
As luck would have it, I got a message back this morning from one of my e-mails (to forumqueries) saying that TMO have paid the outstanding cashback claim and it should be in my account within the next 3-5 days (fingers-crossed). The power of posting in this forum or just a coincidence......you decide![/FONT];)0 -
reading the email from tmo over & over, there is no mention of processing my 1st claim, & they have stated that as a good will gesture they will process future claims. i have replied to them, but it looks like i may have to take the MCOL route after all.0

It has been covered, but for clarification purposes:
If The Mobile Outlet tell you that you have lost your entitlement to further cashback claims, but you have kept to your side of the contract, you can sue for the entire amount that is owing.
In the latter stages of cashback, it is possible to have 2 or 3 claims running at the same time due to them not paying on time, so start proceedings early to keep this to a minimum.

The "forumqueries..." e-mail address is only known to viewers of the many 'The Mobile Outlet have shafted me :mad: BIG TIME' threads on various forums on the 'Interweb'. As they've not invalidated your future claims, with gentle persuasion it would be easy to get them to pay the 1st one. It wouldn't be good for them to be summonsed to court when you have video evidence.Well life is harsh, hug me don't reject me.0 -

I posted in this thread a few weeks ago regarding my first cashback cheque (which incidentally arrived late, sixty-one days after they received my paperwork after after chasing emails) but the cheque arrived on 4th August with different amounts in words and figures (84 in words, 841 in figures) and subsequently my bank refused to accept it because of the error.
I emailed MO twice in the days following my reciept of the duff cheque but got no personal response just the mailbox ones. I then telephoned (premium rate argh!) twice but was told someone would have to look into this and get back to me... which they didn't.
<sarcasm> Shock. </sarcasm>
I then sent TWO recorded delivery letters following the whole Letter Before Action template, the last was sent on 5th September.
Response from MO to two emails, two phone calls and two recorded deliver Letter Before Action letters = silence, nothing, nada, zip.
So Money Claim Online it was and lo and behold faster than a speeding bullet, well for MO that is, I receive two letters from MO on 27th September saying "we have recently received a query regarding your cashback" It was recently like!! Which now says wheels are in motion to re-issue my cashback cheque. Really. Also was my copy of their _dispute_ of my claim. Unreal.
So today I receive a notice from the small claims asking if I accept the claimants response that the claim has been settled... erm, no it hasn't! Yet MO state that they settled the amount owed before the claim was issued... yet they ignored all my correspondance until a claim landed on their doorstep!! And to repeat myself (sorry) I still haven't received any (bankable) cheque from these muppets!!
Any thoughts on this from you wise folks on the forum? I still want to persue the claim because regardless of the nonsense that MO are telling the courts they have not (yet?) sent me a replacement cheque!! And have completely disregarded their terms and conditions!!0 -

I remember giving the Mobile Outlet the benefit of the doubt when you told us what had happened to you. I am still inclined to believe this as non-correspondence is the norm, maybe i'm too trusting? :A
The Mobile Outlet do not have a premium rate number:D , they do in fact have a 'National rate' number, but if you've read this thread, you would know the geographic number to call that would come out of your 'Inclusive minutes'.TenThirteen wrote: »Any thoughts on this from you wise folks on the forum? You have put in a claim and they haven't settled it.

However, have you emailed them on their forumqueries email address? It seems that this address at least is manned by someone with a bit of gumption.Toyota - 'Always a better way', avoid buying Toyota.0
