Glad we've been some help to you tichieboy.

You say that they breached your contract in another way, are you actually saying that you were paid on time(within 28 days) when you claimed your 1st two cashbacks? If you were, Well done, i've only heard of 1 other person being paid in time.

I wouldn't bother using the insurance mistake as a reason for breach of contract, it's been settled, and you appear to have accepted the outcome.

Allthelogins... has raised another pertinent point.
It hinges on when you sent your claim, if this coincides with their mail being re-directed then you may 'have a paddle'.

You don't say when you sent your claim, and I don't know when they started re-directing their mail.

They read the posts on here, but have only started to help people again after 7(?) months away (bar 1 post in June)They will be on here tomorrow answering questions, so ask them.

Hi,
I still haven’t received a payment from this retailer. I received an email from them on 6 th Aug stating that my cashback claim has been successful and that I will hear from them about the payment in 28 working days. As I didn’t hear from them for almost two months, I thought of tracking it with them. I made a couple of calls and first time, I got an impolite answer from an agent saying that I will receive it anyway. The next time I called, the agent repeatedly said I will receive my cashback but didn’t give a definite answer and disconnected the phone in the middle of conversation.

This is my third cashback and I am really worried that I will not get any more payments from them. What am I supposed to do now?

Can I take them to small claims court or do I have to call them up repeatedly?

Please advise.

• Excellent info on the thread above. Anyone know if I should sent my complaint by post to 'TMO, Suite 3-4, Riverdale house etc' or just sent email to the two email addresses given in the 'thread'?

Ey Up guys,

just to chip in my tuppece-worth, when sending e-mails to TMO I always send to all three addresses, these being:

1. cashback@themobileoutlet.co.uk

2. forumqueries@.....

3. customerservice@....

You normally get a response from one of them.

saint, sorry if you took my earlier postings as being somewhat naive/too trusting/not realistic. I was merely pointing out that some members of this forum have benefitted from TMO's participation. In fact, from the earlier thread and their willingness to seem to want to help was why I finaly ordered from them in the first place....

erm...okay...maybe I was too trusting for my own good (but at least I got the first 3 cb :D)

• Another tail of woe from the Mobile Outlet. I got my phone in November last year and was fully aware of the potential problems with the Mobile Outlet, but I thought that by taking every precaution, things would be fine. How very wrong I was. My first 2 cashback claims were both paid, but well outside of the 28 days stipulated in the T&C. My third claim was made in July 07 and was agreed by TMO on 2nd Aug.......I still haven't received the payment! I’ve called and emailed about 6-7 times and each time I'm told that the payment will be made within the next 5 days (oh, apart from the time I started the conversation with "I would like to complain...." and the operator just hung up on me). As I said, I've taken every precaution and have special delivery tickets with signatures for the outstanding 3rd claim and the 4th one that I've recently made. I also got a colleague to countersign the covering letter saying that the contents of the envelope had been verified against the T&C. I'm going to make a claim through the County Court, but don’t know whether to do this for the one cashback claim or wait until they’ve not paid me for 4 and 5 too. Any suggestions?

Welcome to M.S.E

A lot of new users register and ask a question, get the answer that helps them claim their cashback then disappear without even a 'thanks' to those that helped. I trust that your not one of those.

I don't know whether you are new to forums(fora?), but it is always advisable to read the thread from the start to see if the answer you ask has been answered before. This prevents the thread getting seriously long with the same questions and answers trotted out time after time.:)

Have a read of page 1 of this thread, and if you can't find the answer, come back and i'm sure that we will be falling over ourselves to help you.

You normally get a response from one of them.

The response you will usually get is titled "Possible delay - auto response"
It will say:
Dear Customer,

Please note there may be a possible delay in responding to your email
due to a technical issue. We are hopeful to respond to your email within
24 hours. Please accept our sincerest apology about any inconvenience
that you may be caused by this delay. If your enquiry is of an urgent
nature you can call our customer care team on 0870 1999 333

Kind Regards
Customer Support Team

I got this response in July, they won't discuss cashback over the phone, and will often hang-up the phone on you.
To date, they haven't replied to my query.

No problem GunJack,

I am merely offering my opinion, as are you.

I ordered from them as I liked the ease of knowing what bill to send.

They have stated on here that they are trying to cut down on administration . How do they achieve this? By making it a lot harder for us to find out which bill to send.

When the customers who took out a contract from August onwards come to claim in the New Year, do you think The Mobile Outlet's staff will be able to check these bills quicker than they do now?

Watch this thread in January for some 'Real fun'. :A

You really do have the patience of a saint (rubbish pun intended). :A

This thread is probably half made up of posts that were unnecessary given the answers in the first page, but it seems these days most people can't be bothered to look (let alone search) and will just ask; it's the same on another forum I go on, except there they get flamed big style, usually for asking a question that was answered in the post above theirs...

Anyway, got an email from TMO yesterday stating that the final cashback payment was on its way so it seems that TMO can (even if it takes a few friendly nudges) apply common sense to things; just make sure you keep yourself covered with frequent communication (which I did) and sending by Recorded Delivery (or as others suggest Special Delivery with consequential loss).

I wonder if those that suffered from being told they haven't submitted part x or y required put in their covering letters, 'please find enclosed parts x & y required for my claim'; it is more unlikely that you would have forgotten :rolleyes2 to enclose it.... ;)
