    They have now rejected the second claim, saying they were received outside of the 21 days! I have a recorded delivery receipt showing posting on 30 July (billing date was 23 July), yet they only signed for it on 14 August. Is this their latest scam - waiting a couple of weeks to sign for deliveries so that (with the time it takes the networks to send the bills before we can send them) they are certain to be outside the timescale?

    It looks like I'll be filing a second court claim. Does anyone know, can I file for both in the one claim or do they need to be separate claims? Both together would be better to show the judge what dirty tricks this lot get up to, but one is in my Mum's name and the other in my sisters.

    Sorry to hear that. You are not alone. I am in the same position as you I sent two claims 1st class recorded delivery on 30 of July also and they took 8 & 9 days to arrive. I have been told that my claim is also invalid. As you no doubt know the post was and still is being redirected from Shipley to Bradford. Having spoken to a post worker in the area I have been told that when there is nobody to sign for mail they are left a card notifying them to collect the mail from the sorting office. The postal worker has said that they sometimes do not come and sign for and collect the mail that promptly shall we say.

    That's exactly what I was getting at. Many of these cashback companies use all sorts of tricks to invalidate claims, so my first thought was that this was another trick. It makes sense - it can take up to a week to get the bills from the network so by not collecting post for 2 weeks they can be sure many claims will be outside the 21 day time limit. I've sent them a copy of my recorded delivery receipt proving when I sent it so I'll wait see what their response is, hopefully won't have to take this claim to court as well but I'm confident of my (or my Mum's in this case) position if it does.

  • Some advice please (and apologies if a similar query has been asked before):

    I bought my phone from TMO in June with the dispatch note dated 09/06/07 including a number port confirmation that confirmed I could use my new phone from the 15th. I received my first Vodafone bill on the 16th of July which covered two months line rental followed by a second bill on 16th August and am expecting the third bill on the 16th of September. Given that in month 4 of my contract (i.e. this month) I'll only have three bills to send off are they going to deny me my cashback despite the fact the first one is combined for months one and two?

    Some help please, please!

    I hade 2 phones from MO last year - I got my first claim on both phone through ok (well after spending months trying to determine what their T&C was), anyway, my 11th bill came late from Orange (this was during the various postal strike period), anyway for whatever reason my bill was late arriving - and MO have now rejected my cashback claim and future claims (my 12th bill on 1 phone is the 11th bill on phone #2 - one phone got lost so they are running a month behind) due to the bill arriving to them after the 21 day deadline.

    Anyway I got my 12th bill for the 2nd phone and that was also late from Orange and I wrote to MO explaining what happened - I mean I can't send them the bills before I get them can I?. Needless to say they have not responded to my letter and just refused the claim on the 2nd phone too.

    I am really upset as I'm recently disabled (wheelchair bound) and my hubby is full time carer so this is money which we desperately need back, we only took out the deals as we expected our money back and it seemed the only way to get a decent phone at the time. We are now down almost £550 between the 2 phones and I don't know what to do. I'm struggling to pay my rent and buy food (we also have 3 kids) at the best of times on our benefit and we really need this money back - we can't afford to lose it.

    This company seems to have no ethics in my opinion as I've explained all of this in my last letter and as I said they haven't even the decency to respond :(.

    Anyone with advise I would appreciate it

  • i got my first cashback too....

    and guess what ... when i bought the contract it was to send in bill :

    1-4 and 5-6 and 7-9 and 10-11 and then 12

    i sent 5-6 and they received it and after like a month they telling me i should have sent bill 5-7 and my cashback is void now and they wont pay me cashback for the whole year!

  • lets say if we did send in the wrong bill as they say we should have sentin bill 5-7 they say they have received bill 5-6 bill seven has not arrived yet so if i send them bill seven it all should be ok....

    when i bought the contract T&Cs there were 1-4/5-6/7-9/10-11/12 if they change it later on thats not our fault is it... these changes should apply to pple who bought the contract after these T&Cs were applied....
    as in for us we know the T&Cs had at the time of purchase ..its not as if we going to sit there infront of the PC and their website open 24/7 to see if they got any new changes into their T&Cs ......

    it doesn't seem fair AT ALL

    i mean you must have looked at many other websites for mobiles with 12 months free for example "phone box direct" if you send them a duplicate or early claim they charge you £10 admin fee .. unlike TMO who is telling me thet my whole cashback for the year os gone ......
