    Has anyone experienced a rejected claim for not enclosing the despatch note - when you definately have enclosed it?




    I (naively) thought the risks with cashback deals were down to not following the t&cs precisely or the company going bust. I never expected to have a whole claim rejected for not following the t&cs when I have followed them to the letter. I'm fuming! :mad: I even included a letter stating
    I enclose bills 1-4 and also my original despatch note as per the terms and conditions of the cashback procedure. As such I expect to receive your cheque for £84 (£420 / 5) within 28 days. I also enclose a SAE for return of my bills
    Yet the mobile outlet have rejected my claim and then reviewed it and still insisted that I did not include the depatch note. Interestingly, I sent another identical claim for my mother (who has not had a contract through tmo before whereas I have) a week later, i.e. before receiving the claim rejection letter, and this one seems to be going through ok (although we've not yet received the cheque) so why would I remeber to include it for this second claim but 'forget' the first time?

    I've sent a letter before action and will follow through with a court claim. I'm not losing £420 on a blatent lie!

    They have now rejected the second claim, saying they were received outside of the 21 days! I have a recorded delivery receipt showing posting on 30 July (billing date was 23 July), yet they only signed for it on 14 August. Is this their latest scam - waiting a couple of weeks to sign for deliveries so that (with the time it takes the networks to send the bills before we can send them) they are certain to be outside the timescale?

    It looks like I'll be filing a second court claim. Does anyone know, can I file for both in the one claim or do they need to be separate claims? Both together would be better to show the judge what dirty tricks this lot get up to, but one is in my Mum's name and the other in my sisters.

    I don't think their postman would wait around for two weeks to help them to diddle you out of a few pounds.

    Are you new to this thread? recorded delivery is a waste of money.

    If i've said it once, i've said it a thousand times: Always send Special Delivery with consequential loss. :)

    Why have you sent a claim to a P.O box? :confused:

    I love it when people ask a question, and then reply to my answer with a sarcastic comment based on their incorrect understanding :)

  • I was just checkin to see if my 4th claim had be received and noticed it had been redirected. Is everyone still sending the claims to suite 3-4 etc or is there a new address.

    Thankfully I have the cheque for claim 3 cashed so I have more than 50% of my cash back.

    sorry I havent been on the thread in a while but been very busy..not sure I will take another contract out with them too stressful ;-)

    I am in the same position as yourself, having taken out the contract before August 2007, claims should be sent to the suite 3-4 address

    you must have taken your contract out prior to August 2007, so the address to send your cashback claims to is the original address, i.e.
    3/4 Riverdale House
    Dockfield Road
    Shipley
    BD17 7AD

    which is now what the T&C say again, and not the PO Box that the T&C stated temporarily

    I know this is of no help in your situation, just trying to clarify things...

    My mistake, it's one of the other cashback companies that has a PO box address. However, there have been posts to say that TMB has been having their mail redirected.

    I'm sorry if you've taken offence to my "sarcastic" comment, but how exactly is it helpful going forward to say I told you so this is what you should have done instead? How exactly would sending special delivery with consequential loss have saved me from the lie about the delivery note not being included? How much of an advantage would it be on the "late" delivery situation when I have proof of posting that (time will tell) if it has to go to court will be enough for a judge to show that I have done enough to meet the terms and conditions?

    I'll happily post on here my experiences and even mistakes as this is how we learn from each other, and I have found it to be of great use to see how others situations have developed with these companies. But unhelpful comments serving only to make someone in bad situation feel worse so that someone else feels good, I'll just ignore for now on

    After I've had several years of successful cashback deals, my whole family now has mobile contracts through cashback claims (with TMO, CNM, e2save and PBD), which I look after for them i.e. I remember when to send the claims, I check which documents to include, I read the forums, I keep all their phone bills in a safe place until we send the claims off etc etc. I do all the work, they get free phones and contracts with full knowledge of the risks but without all the hassle of doing all the work themselves. Of course if my Mum's or sister's claim has to go to court they will file in their name, but again I'm the one following other people's experiences and advice on the forums and so I if necessary I will be preparing the court claim with them or for them. I say "I" instead of saying "I, on my sister's behalf" or "my mother, with my help" because it's simpler, that's all.
