I will do. Does anyone know if you can claim back money lost through attending the court case?
GunJack's advice posted above is incorrect.
If you win you can ask the judge for your expenses incurred in attending the court.
You can ask for your travelling expenses to be paid by the Defendant, and also up to £50 for lost earnings.
It is up to you to enforce the judgement, any costs awarded are added to the original claim.

quentin - thanks for the correction. I was basing on a mate who tried to claim this way and was disallowed, maybe the beak was having a bad day. He got travelling expenses, but didn't get the day's pay. Happy to be put right if it's good gen !!......Gettin' There, Wherever There is......

If it does come to a hearing, take evidence of your loss of earnings to back up your request.
The level of out of pocket expenses related to the day of the hearing is decided at the end of the case. You need to request them (after hearing the judge's decision on the case).0 -

Has anyone experienced a rejected claim for not enclosing the despatch note - when you definately have enclosed it?
I (naively) thought the risks with cashback deals were down to not following the t&cs precisely or the company going bust. I never expected to have a whole claim rejected for not following the t&cs when I have followed them to the letter. I'm fuming! :mad: I even included a letter statingI enclose bills 1-4 and also my original despatch note as per the terms and conditions of the cashback procedure. As such I expect to receive your cheque for £84 (£420 / 5) within 28 days. I also enclose a SAE for return of my billsYet the mobile outlet have rejected my claim and then reviewed it and still insisted that I did not include the depatch note. Interestingly, I sent another identical claim for my mother (who has not had a contract through tmo before whereas I have) a week later, i.e. before receiving the claim rejection letter, and this one seems to be going through ok (although we've not yet received the cheque) so why would I remeber to include it for this second claim but 'forget' the first time?
I've sent a letter before action and will follow through with a court claim. I'm not losing £420 on a blatent lie!

Today (Day 39) after some polite email prompting (2 emails), I received an email from TMO cashback team indicating that I should receive payment within 7 working days. I'm prepared to wait till next Thursday, as this happened with my last claim, and I was paid within the promised timeframe...even though it was still 13 days late.....
I'll update the board again next Thursday...or earlier if I receive payment before then.....LOL0 -

Very sorry if this has been answered before. I read through 10 pages and could not find an answer.
Could anyone tell me if I can cancel if I have not received my phone?
I placed my order last week and was told that my phone would arrive on Tuesday, it still has not.
They gave me a royal mail tracking number, the royal mail know nothing about this number and say the parcel has not been dispatched!
I rang TMO customerservice and told them that i want to cancel, he replied that I cannot as the phone has been dispatched. He told me to wait, get the phone then cancel it.
Amazingly it seems that if I follow his advise i will have to pay £15 cancelation fee.
My long winded question is:
if i refuse delivery of the parcel from royal mail will I get a full refund?

The Mobile Outlet will give you a tracking number for an item they have still in their possession. :mad:
Phone, and e-mail them on at least 3 of their e-mail addresses cancelling the order, give a reason why.
Refuse delivery of the phone if it arrives, it will be sent back to them.
they may try and levy a fee, this is against the Distance Selling Regulations, mention this in your call/letter.
I am not sure what you mean by "A full refund", unless you mean the £1.99 fee? :AWell life is harsh, hug me don't reject me.0 -

Today is Day 2 - PO tracking says cb#4 of 5 claim was delivered yesterday. I have done nothing different from the other claims, and fully expect to be reimbursed. I will, as always, keep the board updated.
