Hi All.. I ordered an N70 on t-mobile (35flex +webnwalk) on 10th august.. first it was not in stock then i got an email on 15th that it is in store and connected and they are send it to me on that day.. but nothing received yet.
can any existing T-mobile subscriber please tell me if tmobile sends bill in first week of month or on the date you connected???
As to me it seems that they are trying to play with 120 days game...
I read similar message few days back.. but no one clearly answered that..0 -

I've gone through the other threads.
Oh! boy I didn't know that TMO is such a rip off. I was taking them lightly.
It seems I need to do my homework in getting my paperwork done.
As I said I had 2 contracts with them. Usual delays and letters, e-mails etc.
Having fed up I used MCOL route and got my first contract. I got money back but not without MCOL route. However they refuse to pay court fee. For this first case they have not defended it. 1 month has passed since claim issue.
What shall I do with this? Shall I enter into Judgment by default?

This is quite interesting.
They never sent me dispatch note. I sent them e-mail asking to send it to me which they never did. So I couldn't send them dispatch note and as usual they refuse to pay anything as first claim was defying t&c.
However I kept sending all the bills as usual with signed for post. One was delayed (I need to check it if it was really delayed?)
To cut it short I took again MCOL route which they have defended (They are counting on their T&Cs)
Another problem with these people is that they never sent for which contract they are issuing cheques so I had no way to correlate which one is for which contract.
They are also arguing that they have paid for first claim from my second contract. I wonder how could to that since I never sent them dispatch note

1. It would be good if you had correspondence from The Mobile Outlet in answer to your missing dispatch note.
=> I've e-mail well preserved.
2. Do you have the t's & c's? If you have the original, it would be easy to prove that the dispatch note is not on the reverse side.
If you don't have the t's & c's it is up to you (The claimant) and not The Mobile Outlet (The defendant) to prove that a different set of t's & c's applied.
=> For t&c they say see website it is same for all contracts. I had it in my first t&c. I never received it.
3. The courts can overule t's & c's, but this won't be established until you've answered point 2.

I would like to know what should be my next steps for contract - 1 & 2.
for contract 1 I want to get back court fee.

In answer to my question about you having correspondence from The Mobile Outlet, you say that you have an e-mail preserved. Can you confirm this, as you seem to say that you have your e-mail preserved.
The Mobile Outlet currently have 2/3 sets of t's & c's running together, if you have written correspondence from them saying "See the website, it is same for all contracts." It is possible to have differing t's & c's if you ordered 1 contract on a Monday, and another on the Tuesday, it is up to you to show what you had.
Did you get e-mails telling you that they were sending a cheque? These usually have an order reference number so that you know what contract you are being paid for.
I would try and keep your correspondence regarding each contract completely separate, as it may confuse a judge if you go back to court. :AWell life is harsh, hug me don't reject me.0 -

Yes.
When you ask for judgement, you input the amount they have paid so far, which will leave the balance of the court fee still outstanding.
You will get judgement against them for that amount.0 -
I signed up over a week ago for a free 12 month contract with mobile phone outlet and have still not received the phone. However I was unaware of how bad a repuation this company has regarding cashback. Should I cancel new before I receive the phone and get out whilst I can, and go with another company or am I panicking too early!0
