What's significant is that The Mobile Outlet, which monitors this thread, has, as yet, made no response on here to the suggestion that its new Terms & Conditions would render it impossible in many circumstances to file a cashback claim that is valid.

I think there would be more chance of you cracking a smile Shelby than that ever happening! :D

I am expecting the present Terms & Conditions to change very quickly tho'. Depending on how you look at it, now could be the best time ever to take out a contract, as you'd be guaranteed to win your whole cashback entitlement plus court fees straight off.

Everybody?

Well, I for one didn't know what you meant. Indeed, it made me wonder if you were actually on a Pay As You Go scheme instead of a monthly account.

You make a lot of presumptions in your rebukes and make no apologies when they turn out to be wrong.

It is not an ideal way to obtain assistance from people.

Lighten up!! People like you really worry me!

Why would I be commenting on a cashback thread if I was on a pay and go scheme?? Why would mobile outlet give me a free w580i on pay and go?

No.

You pick only one Connection Date (10 September) which coincides with one that I quoted myself and in analysing the ramifications of it it is you who err.
Ah but we both err. I take your point about the 1 day and I could have been more precise stating exactly what the date means. When sending in claims, one needs a lot more than 1 day breathing space for postal delays, good business days etc, so anyone doing cashbacks ought to be adding in way more than 1 day breathing space.

Voda invoice dated 19 January would arrive on 26 January, would show you've been connected for 107 days. Not sufficient for claim.
From my table you can see that this should read 131 days, so the consequent logic in your statement is wrong as there are sufficient days for a claim. I only chose one of the dates you mention, some of your other dates are wrong too. Instead, I was hoping that the table would provide an alternative way of backing up your argument that it is impossible to meet their conditions, even if some of your calculations were wrong. I agree with you!

If you're going to dispute what I write, it would be helpful if you could get your own facts right before you casually remark that mine are wrong.
Well I apologise for getting the one day wrong, I didn't think it a big deal. I spent quite some time calculating the dates, so there was nothing casual about it. Hopefully I have done a better job this time at making my point.

The best and safest method of working this one out is to switch off your computer (particularly if it runs on Microsoft software) and sit down with an old-fashioned calendar, a piece of paper, a pencil and a full complement of fingers.

Well I happen to have constructed that Spreadsheet on Open Office on Ubuntu (Linux). Your fingers and paper approach got it wrong, my spreadsheet calculations were wrong. The lesson here is that the margin for error is always there for these cashback deals and completely unreasonable in the case of Mobile Outlet. Even Shelby who has probably spent more time analysing the agreement and dates than the rest of us, can make a mistake. Anyone considering these deals must realise that there is a high risk of getting it wrong. It is no different to trading risky strategies on the stock exchange. The higher the risk the greater the potential gain.

I'm still considering a cashback deal, but thanks to this informative thread, it won't be with the Mobile Outlet.

Dear Customer,

A payment of £183.75 has been paid via BACS today, this will take between 3-5 working days to clear into your account, sorry for the delay. If you have any further questions regarding the delivery of your handset, please email our customer service team. I have still not received this payment into my bank account, even though I have e-mailed them twice since. The last one I sent was on Friday, and I had the usual automated response to say there may be a delay.

Any advice on what to do now?

Thanks

Hi clareski,
have you tried emailing forumqueries@themobileoutlet.co.uk ?

Well - I have e-mailed customer services and forum queries, and have not received a reply at all. Can't believe that they said it would be 3 -5 days and now nothing.

Should I try the small claims route now, and whats the best way to go about it?

Nice spot :)

Can anyone who bought a phone in the 1st 2 weeks of August confirm which address was supplied with the paper copy of the t's & c's?

Sending to a defunct P.O.Box will lead to a lot of anxiety.

I have sent another e-mail to both forum queries and customer service saying I would take this through the courts if I dont have a response within 48 hours.

The e-mail you sent is a waste of time.

I'm not sure if you understood the 1st page of the thread, but what you need to do is: Send the Mobile Outlet a letter titled Letter Before Action(LBA).

The 'Action' is taking them to court. It is best to Send them this letter by snail mail (Send two from two separate post offices with proof of posting if you are being cautious) and give them 7 days to deal with your query.
after 7 days, file a court claim online (details on 1st page).

For example:

LETTER BEFORE ACTION

Dear Mobile Outlet,
I have been e-mailing and phoning you for 10 weeks with regards to my cashback offer.

You haven't bothered to respond to any of my queries so I will take you to court if you don't sort it out sharpish.

I give you 7 days to process my claim, on the 8th day I shall be filing a court claim. Once I file the court claim, you will be required to pay me my cashback, court fee's and interest.

Thank you :)

Obviously, spend some time getting it to sound like you mean business, but i'm sure you get my drift. :A
