    I'm not sure if you understood the 1st page of the thread, but what you need to do is: Send the Mobile Outlet a letter titled Letter Before Action(LBA).

    The 'Action' is taking them to court. It is best to Send them this letter by snail mail (Send two from two separate post offices with proof of posting if you are being cautious) and give them 7 days to deal with your query.
    after 7 days, file a court claim online (details on 1st page).

    For example:

    LETTER BEFORE ACTION

    Dear Mobile Outlet,
    I have been e-mailing and phoning you for 10 weeks with regards to my cashback offer.

    You haven't bothered to respond to any of my queries so I will take you to court if you don't sort it out sharpish.

    I give you 7 days to process my claim, on the 8th day I shall be filing a court claim. Once I file the court claim, you will be required to pay me my cashback, court fee's and interest.

    Obviously, spend some time getting it to sound like you mean business, but i'm sure you get my drift. :A

    Good advice saint...I would also include all the details of attempts to resolve the matter with TMO. Document all communications with dates, to illustrate that you have made every attempt to resolve the matter with TMO before escalating to this level....

    Agreed with kltpzyxm and Saint claresk.

    Although it sounds harsh, you should be firm in your dealings with TMO now or you will delay things further. You've been more than nice to them already.

    So I submitted my claim online for the small claims court on Friday. The cheque arrived today dated the 10th for the 1st cashback due, which I very much doubt is correc6t as I also received confirm of my claim from small claims court, so stuff is not going missing in the post.

    That was my line of thinking, until |I checked the addres,s and they had incorrectly put my postcode, theyre flamin useless and Im proceeding with my claim as they did not pay me within the time directed on their terms and conditions.


    As for LETTER BEFORE ACTION, give a timeline, when you submitted the claim, when they received it, and details of when you have emailed/called since then.
  • I think thesaint has worn me down. My W580 on t-mobile is at the local royal mail centre awaiting my pickup, however I am having 2nd thoughts and may cancel/return it. Firstly I'll sit down when I know my connection date and calculate when the cashback claims need to be submitted, then try and work out when I'll actually receive the invoices and ask t-mobile if it is possible to amend my invoice date as alluded to in a previous post.

    In the meantime, anyone know of any fantastic t-mobile 12 month free deals doing the rounds at the moment ?

    I wouldnt use them again, the amount i have spent ob special delivery letters, phonecalls, etc, they're useless. And their attitude stinks. I am constantly told 'go on,m take us to court, you'd lose and look an idiot. Read out T&Cs' :rolleyes:

    Today get their defence contesting it all full

    She said I was notified that payment was delayed, at no time did they deny my cashback, it was just delayed so I have no case at all, and no way would they pay the court fee.

    I don't bother with phone calls, In your position I would record phone calls with them and then type a transcript and send it to them in an e-mail.

    Since you've already paid your fee, I would go ahead and claim the entire cashback minus what they've already paid you.

    Under the terms of your contract payment was to be made by specific deadlines.

    There is no provision to extend the deadlines.

    You have waited long past the deadline, informed them in a LBA that unless they paid you would take action, gave ample notice, but the LBA was ignored.

    Just let the claim take its course.

    OK, have now received the W850 and have spoken to t-mobile. My connection date is the 21st August and my 'bill' date will be on the 24th of each month. T-mobile confirmed it is easy to amend the DD date and therefore the bill date, so I think I am going to go ahead with this. With the quidco and selling the phone I won't be too badly off even if I have cashback issues.

    Looking at my disptach note, they have included a sheet of vouchers and the t&cs make no mention of sending in the dispatch note with the first claim. However I haven't read them fully yet.

    My paperwork has both addresses - the cash back vouchers give a cash back address of the PO Box 259 etc, and the t&cs quote the riverdale address.
