    So I was going ot raise a small claims claim on Tuesday. I called to have one last moan and was told that a cheque had been sent on the 10th. It hasn't arrived yet I have received plenty of post posted after this date...some even for abroad. Yesterday, I received an automated email telling me they had received my cashback claim and that I should wait 28 days to receive it.

    What should I do?

    If you have sent a letter before action giving them a deadline to pay you and they have missed the deadline then proceed with your action.

    I signed up to TMO in december, sent my first cashback claim, after a month of no reply, I emailed them telling them I will make a claim against them and they sent the cheque immediately.

    I sent my second claim which included the 3 bills required. After a month I got a reply saying that I had not sent in the 3rd bill and that my cashback was invalid. Not only that, they said ALL of my future cashback claims will also be invalid!!!!

    I emailed them saying that I had sent all the correct bills and that I will make a claim against them if I do not recieve the cheque within 2 weeks. I had also told them that I had sent my third cashback claim and that I should be paid for that too.

    It's been 2 weeks and I still haven't recieved a reply by email or a cheque. Even worse, I did recieve a letter for my third cashback claim saying that my last cashback claim was invalid so this claim is also invalid.


    I have a few concerns, where in the terms&conditions does it say that all future claims are invalid if one claim is invalid? I signed up in december, did they have the same terms&conditions then? (does anyone have a copy of december's terms and conditions?)

    If I make a claim against them, how can I prove that I had sent all 3 bills? I sent it via recorded delivery but it doesn't say what is inside.

    Please HELP!!! Thanks in advance :(

    OK I will ring t mobile now. I don't understand what you mean though about connecting within 7 days??

    The terms say you send the first voucher 120 days from and including the date of connection with a bill showing you've been connected 120 days.

    Just finished with mobileshop so I am well versed in cash back squabbles. Will make sure all claims sent on time, via recorded etc so relatively confident about the cashback, provided of course they keep trading ;) .

    14th August is my connection date. I have to say, I am VERY impressed so far with everything. T mobile are brilliant :) Woman at customer service was lovely, very helpful (unlike o2 may I add) , they send you a text message every week telling you how much you have left in your contract package, and you can use the amount (was £120 but down to £95 now) for whatever you want! Calls, texts or pictures :) Excellent.

    Ok, so just claiming, double checking against details on the front page, in my letter before action i said they had to pay within 5 working days of receipt of the letter, will that weaken my claim for not being generous enough?

    Since being told on the phone that a cheque was sent on the 10th (not received), I have received an email stating 28 days :mad:

    taken the plunge and submitted a claim for 470 in total (50 court fee) for the entire contract

    This is what they call "The missing page" method of denial.

    ashy, it is evident to The Mobile Outlet that you are making threats that you have no clue how to follow up.
    You're claim would fail because you have not followed the procedure for doing so. How were you going to prove to the judge that you were wrongfuly denied your cash back when you don't have your t's & c's? :confused:

    Your missing/lost/thrown away(delete as appropriate) t's & c's (11.3) State this amongst other bumph:

    ..If any one stage is not complied with, you will loose(sic) your entitlement to claim the whole of the cash back...
