    Well, quidco has tracked so that is something....

    Just finished with mobileshop so I am well versed in cash back squabbles. Will make sure all claims sent on time, via recorded etc so relatively confident about the cashback, provided of course they keep trading ;) .

    Extracting what's rightfully yours from The Mobile Outlet is not what I would call a "Squabble", that's like saying Saddam was "Not a nice man" :D

    I had 2 contracts with them.

    They started delaying and not paying cashback for first, I took them in court and they bowed down and paid.

    For my second contract they refuse whole cashback stating that I' haven't sent them dispatch note. I never rcvd it and I've informed them (e-mail preserved). They also say that I delayed sending of few bills.

    I took them again in MCOL for 2nd Contract which they decide to defend.

    I'm preparing for final showdown in case they got balls and decide to go till hearings.

    I've following points with me
    1) I never rcvd dispatch note, which was informed to them as soon as I got my mobile pack. I've preserved e-mails

    2) For my first contract they never asked for dispatch note. Ironically both contracts have same T&C. I got point here that how they can have same T&Cs applied differently for 2 contracts

    3) Can T&Cs be overruled by court in these circumstances?
    It is common sense I paid all bills sent them all bills they have to pay cash back. It doesn't matter of some of bills are delayed by few days. T&Cs are obviously rip offs.

    Any thoughts?

    In answer to your points:

    1. It would be good if you had correspondence from The Mobile Outlet in answer to your missing dispatch note.

    2. Do you have the t's & c's? If you have the original, it would be easy to prove that the dispatch note is not on the reverse side.
    If you don't have the t's & c's it is up to you (The claimant) and not The Mobile Outlet (The defendant) to prove that a different set of t's & c's applied.

    3. The courts can overule t's & c's, but this won't be established until you've answered point 2.
    They also say that I delayed sending of few bills.

  • Am really hoping someone can help me on here.

    I am due to send in my first claim to The Mobile Outlet at month 4 of my contract which is August, however, I have two bills for June as I changed the direct debit date and I also ported my number with me therefore some of the bills have different numbers on.

    I will therefore be sending in the following:

    May invoice – new number
    June invoice – change of numbers
    June invoice – change of direct debit date and ported number
    July invoice – ported number
    August invoice – ported number
    Original dispatch note

    I have emailed TMO and phoned them but am getting no help from them at all...they are soooo annoying. Does anyone know the answer or had a similar problem?

    I'm trying to find the good guys as far as 12 month free contracts go and them not fussing about cash back claims. I tried ordering from the Mobile Outlet but the order still hasn't arrived after 3 days even though they claim royal mail special delivery before 1pm the next working day and my status is connected. I'm considering cancelling the order if this persists through the weekend, and after reading their new T&C's I suppose I was a bit quick at jumping the gun, are there any companies with a good rep left?

    I would cancel your order with The MobileOutlet, the grief you will get is not worth it.

    I've not had any experience with your problem, but what I would do is send off the paperwork on Monday.

    Include a covering letter stating that you need clarification within 'x' (The amount of time you have left to submit your claim, minus 2 days for you to resend it if needed) days if you've submitted the wrong forms.

    Keep copies of everything you have sent, and post it using Royal Mail special delivery, with consequential loss.
