    Besides; I've yet to come across another place which actually has (among many other wonderful tripwires) amongst it t&c that they will charge you for non-use of your phone....

    They don't actually state that. It is not clear what they mean by term 17.3 "Non usage report". They could be saying;

    a. If you do not use the sim card, we will charge you for the handset.
    b. If you do not use the handset, we will charge you for the handset.
    c. If you do not use the sim card with the supplied handset, we will charge you for the handset.

    Since it is not clear to the consumer, I would hazard a guess that a, b and c were all unfair contract terms.

    I would hazard a guess that there's no advantage to me in finding THAT out - they are ALL bad news and only there to penalise me.

    Considering the entity that loses out most on a cashback deal is the service provider and they want to sell you lots of nice 'bolt ons' etc, they will be the ones that would get most upset if you don't use the phone.

    I doubt the cashback company really cares that much if the phone is used, apart from if they lose commission from the provider which sees the non-usage.

    I very much doubt it affects the dealers' commission. I've been told a lot of rubbish by some of them about many things when the real reason is simply to try to get out of paying people cashbacks or hit them with penalties even when they do!

    Regarding the three terms above, it doesn't mention what form the SIM usage should take. So if you just received calls, would you be in breech of contract? Receiving calls requires usage of the SIM. Pedantic I know.

    I called TMO today on their 01274718568 number and was told my N70 was out of stock. The stock manager was out for lunch and I was promised an e-mail confirmation of the delivery date by 6pm wich has not arrived. I'll be calling back tomorrow to check up on it, but they did say if it was not going to be in stock I could request an alternative handset which I will try to get on the same contract/tariff and with the same cashback.

    Keep yur fingers crossed we may be getting somewhere. I phoned up again this morning after not receiving the promised e-mail and have switched from the N70 which is still out of stock to the K750i. It's an older phone but I'll eBay it and use the sale to offset my purchase of the N95. I've asked for e-mail confirmation and have also confirmed that this will not affect my cashback/tariff.

    Fingers, toes and everything else crossed. They said it should be with me by the end of the week.

    Just to warn people looking into cashback deals MO have changed the T&C's wef today.

    It is on their website under August 2007 rules (old ones are still on there too!) It only applies to deals starting today so anyone who has bought previously isn't affected - before anyone starts to panic!

    Changes include:
    Different address to send bills to
    slightly confusing dates - now going off days since connection date (similar to CoolNewMobile & PhoneBoxDirect)
    And just one bill each claim (not all previous bills)

    So it is still bills 4, 7, 9, 11 & 12 but depending on your billing date you may have to send in bills 5, 8, 10, 12, & 13. You will have to count the days since your connection and send in the next bill after that date.

    Hmm they do like to make it difficult for us :(
    Wondering how to have a life & not rack up more debts...

    Careful of what you post, not using the correct phone could possibly invalidate your T&Cs for cashback... ;)
