    Notice that you get paid within 45 days and you can claim within 30 days of each installment dates.

    They say they must receive the claim within 30 days of the due date otherwise all claims are void.

    Even more essential to use special delivery to prove on what day the claim is received.

    But recorded delivery also shows which day the claim is received?

    1) It doesn't guarantee delivery on any particular date - the post office won't investigate any lost recorded delivery items until around 15 days after they were posted.

    2) It doesn't safeguard your item whilst it's in the post (recorded items go in with all other post)

    3) You cannot claim the value of the cashback if it is lost

    4) There is plenty of evidence that recorded items can still be delivered without the recipient having to sign for them.

    This is in my T&C

    When you buy a contract/pay monthly package from The Mobile Outlet you must use the SIM card provided with the handset. If we receive a 'non usage report' from the network that you are connected to, you will be liable for the full retail price of the mobile phone.

    My 1st impression on the new T&C's:

    They've decided to muddy the waters with this "Installment date and connected for 120 days etc from connection.(I said a few weeks ago that the old system was easy to understand, seems like they agreed with me).

    45 working days for payment? This is double the time they promised before, were they telling the truth about their "New" system that was going to speed up our claims to be paid within 28 days?

    They specifically state the use of the supplied phone with the supplied sim.
    (This would be thrown out by a court, a free phone is yours to do what you wish). They would need to specify that the handset belongs to them until the contract is up for this to be enforceable.

    I'm glad to see they corrected their spelling mistakes at last.

    The 120 days since connection is the final nail in the coffin for me, it seems like they want to lower the bar now that the other cashback companies have adopted their shady tactics.

    Still loads of unenforceable terms, but that works in our advantage.

    Expect fun and games over the coming months :)

    Hi, thse 'new' terms, I take it they only apply to new customers not existing customers? I know it's been stated over and over again but I just want to be sure - you're only bound under the T&Cs that were there when you signed up, right? If they want to change the terms, can they do this on the website and you have to follow them, or do they have to give it to you personally in writing?

    You only follow the terms that are supplied to you when you get your mobile. Mine was printed on the back of my despatch note. When you get your T&C's scan them and every time you send in a claim for your cashback, print out a copy and sent it along with your claim.

    I am claiming my 2nd cashback. My 1st cashback was paid within 28 days.

    Based on Royal Mail:
    11th bill delivered on 15/5/07 (TMO confirmation email on 18/6/07)
    12th bill delivered on 13/6/07 (TMO confirmation email on 30/7/07)

    I have waited 50 days (22 days overdue - based on TMO Ts & Cs, they are supposed to pay within 28 days). I emailed a friendly reminder in Jun and July, but all I get was "Possible Delay - Auto Response". I called on Monday, and said I would raised a small court claim. But, the customer service officer said usually they wouldn't pay up and even if they pay, it will take up to 6 mths ???!!! Is this true?

    Should I just wait? Or raise a court claim.

    Any advice is highly appreciated. Thanks in advance.
