  • It seems they've sent people the same blurb as was released on the web, which doesn't really answer any questions and just puts blame at the feet of others!

  • Ok wonder if someone can help me to save me reading alot of posts. I have sent them a LBA and not heard back from them, from the above post a letter from them it seems as though they are still trading, is it still worth taking them to court for the money they owe me?

    Are they arguing the point with people who do take them to small claims?
  • Just for info, Both my wife and I went to the offices in Bradford on Monday and was told that nobody was in the office today, (another couple were there as well). We returned on Thursday and was told that nobody had been in all week. I am definitively starting to feel the worst about getting any money back. This is the last time I will be taking out cash back offers after having my fingers now burnt twice!!! - not happy.

    It would be worth reading through the thread to help you to reach a decision about whether to risk any more money in the light of this weeks developments.

    Under the present TMO response, you need to budget £140 for a MCOL:

    Issue fee (amount being claimed £300-£500): £35

    Hearing Fee: £50

    Application for a warrant of execution: £55
  • Just spoke to T-Mobile and they were most unhelpful.

    They won't reduce either of my price plans until 11 months (big deal!!), but did offer me £5 discounrt per month, which I took on one, and will take on the other once the 6 months has passed.

    What annoys me is the reverse of all my bill say I CAN downgrade after 6 months but she went away and said the system just wouldn't allow it, not even her manager could override it.

    I will now try Orange for my 3rd TMO contract to see how sympathetic they will be.

    Edit - Orange much better - initially was only offering reduce 1 level to £35 pcm, but when I told story, offered to go lower to £25 so at least I can mitigate £15 x 6 =£90 less cost.

    Sent complaint to T-Mobile as don't think they very helpful.

    NB for other people with T-Mobile, you could ring them up and get negotiate the £5 discount as it won't alter your price plan so won't invalidate your Cashback T&C's in case TMO do come back to life with money to pay out (oh look there's a flying pig outside my window)

    If it says you can change tariff on your bill surely that is part of your contract. Phone again not taking no for an answer- and consider court action against T-Mobile to reduce the bill (as it is your T&Cs with tham). Of course you need to keep paying the bills though...

    You might get a better response once TMO have actually gone bust - right now it is pure speculation, albeit pretty good speculation!!!

    I had a similar experience when Coolnewmobile went down. As soon as I heard, I contacted Vodafone to ask for some help but at that stage they hadn't officially been notified about CNM's demise. So, I wrote a lengthy letter to their Customer Services and got a stupid, curt and non-helpful reply saying that I couldn't change the terms and if I wanted to end the contract I had to pay all of the remainder owing!

    Some days later I called up Vodafone again, by which time they had been notified of CNM's situation and straightaway they offered to halve the monthly payment (it was £40pm) and reduce the term to 12 months (I still had 16 months of an 18 month contract to run).

    Let's wait and see what happens......

    I phoned T-Mobile this afternoon, requesting a downgrade. My request was simply refused. Then I mentioned the information at the back of bills, which says that "You can also move to a lower priced plan after your first 6 months". The girl on the other side claimed that they used recycled paper, therefore the FAQ on the back of bills is not suitable to all contracts. We have to stick on the terms and conditions provided by T-mobile when I received the phone. I told her that I didn't receive any T-Mobile's terns and conditions. She said they provided it to Chitter Chatter, who should provide to The Mobile Outlet. In that terms and conditions, we can only change price plan after 11 months. I argued that first I didn't receive any T-Mobile's terms and conditions, secondly, the FAQ appears every month. I thought it should agree with their terms and conditions. But she refused.

    Any suggestions? Whether can we use the FAQ to take some further action against the T-Mobile or not? Thanks
