    It seems academic now, but if you claimed the full value of your contract (rather than just claiming for late payments), then the court has agreed that the contact has been fundamentally breached and no longer exists. Barring any appeal from TMO against the judgement you could downgrade your contract.

    But if your claim was for the late payments, and further claims would have to be made, then (were they in a position to pay up) you should stick to the cashback conditions.

    Also interesting is the IMPDA which i have seen on this forum, looks like they are going to make some form of announcement on the 20th, they are also on MBmagazine here http://www.mbmagazine.co.uk/index.ph...842&Ite mid=2

    If they have something they are going to do to stop all this they have my vote, we will have to see what they say first.

    I suppose it now means i will have to go to court now to get my money, cos i cant see i will get anything from mobileoutlet now

    Talk about trying to give everyone on here some useful info, I got it first hand from someone at the impda in fact they have told me that MO is putting out a letter to all their customers Friday i.e. today.

    So if you think its rubbish wait until you see the letter, then you can appologise. Jez some people.

    Sorry if you took my comment the wrong way - I didn't mean it was literally rubbish, I 100% believed you, I was just annoyed at TMO for spouting stuff about how they have only recently been having trouble paying cashbacks when clearly this has been going on for a long time. I really do appreciate all the helpful comments I have received from everyone here and apologise profusely if I might have offended you.

[EMAIL="e197489794@exchange.1and1.co.uk"]e197489794@exchange.1and1.co.uk[/EMAIL] I did a Spam Locator check on the email headers and the message originated in Tehran, Iran. It would be interesting to know if there is any significance in that.
  • So is now the time to try and negotiate a network reduction in my contracts?

    Is it worth waiting to see if TMO will ever find funds to repay our cashbacks - and if they do, who gets it first - those with MCOL's and bailiffs?

    I am only now getting to the 1st 45 days point for my cashbacks being due so couldn't do the MCOL (and in any case I intended to call in person first).

    One of my contracts is so barely used (wifes fone) that cashback was the only reason for taking it out.
    I didn't do it, nobody saw me do it, you can't prove a thing! ;)

    Sorry didn't mean to say it was rubbish was just wondering where you found that out from - am also annoyed with TMO for the statement released as it is BS. Just didn't want people to think TMO was going bankrupt without knowing that it was, if that makes sense!!

  • Well looks like i was right worse luck, no point in me taking any court action cos i aint going to get anything now, and if anything its now put me off getting a phone from anyone doing cashbacks ever again, i say this cos i Just got the post and a letter from TMO, its taken a bit of time to copy from the letter but this is what i got

    To whom it may concern,
    Over the last number of weeks we have received complaints from customers regarding the status of their cash back applications. In order to clarify the situation and help customers understand our current predicament the following statement has been prepared.
    There has been an unacceptable delay in paying customers at present and the reason behind this is due to commissions that are owed to us being withheld from numerous suppliers. We have not issued a statement previously as we believed the situation would have been resolved by now. Unfortunately we have not received the money outstanding and have no choice but to let our customers know of our current status. We appreciate that the inconvenience caused by delayed payments is unacceptable, but we would like to stress that we are attempting to resolve matters and the utmost will be done to ensure all customers receive any cash back due.
    The industry suffered a huge setback when a couple of high profile retailers shut their businesses towards the end of last year. A few of the networks reacted by removing connection codes not allowing any further connections. This was done without looking and treating each business on its own merits. A gung ho reaction in our opinion!
    Chitter Chatter, one of the suppliers we are in legal proceedings with refused to pay commission due at the end of last year – citing their own financial problems. The money due from Chitter Chatter was used to apparently sustain their own financial shortfalls. This has had a negative impact on our business and subsequently our customers are having to suffer. It is important that customers appreciate that their delayed payments are partly a result of such companies looking after their own interest before our customers, a practice which we believe is completely selfish.
    Dextra Solutions is another company with which we are in legal proceedings with for withheld commissions. We believe they have closed our account unjustly and are holding commissions which our customers are entitled to.
    The IMPDA have been contacted and have been made aware of the situation. We are hopeful to arrange a potential meeting with OFCOM to explore what help they may be able to offer in dealing with the issue. Trading standards are also aware of the overall status with each supplier.
    We ask our customers to remain patient over the next few weeks whilst we are dealing with the non payment of commissions. We will send out an email keeping customers informed and updated as and when we have anything to report.

  • What they don'tr say is should existing customers keep claiming cashback's as and when they become due, as if you don't we will (if we become viable again) refuse your entire years' claim!!

    Or are we just wasting time and postage costs?

  • This is purely my opinion and not based on fact but I think this is a delaying tactic. No where in this letter does it mention that they have 'gone under'. And, as usual I have still not had any correspondence from TMO!
