I requested a warrant last week which has been accepted and transferred to Bradford for action by the bailiffs.
Does this really mean that this is now a waste of time? As mentioned above, they've not gone bust yet and they've been paying out a few cheques when bailiffs have visited. I really hope I get something back having taken it to this stage!
The whole thing is a shambles though, run by crooks throughout! Can't believe it's taken them until now to release this statement.0 -

presumably you have already paid for the warrant, so just sit tight and wait to see what happens....I sent my claimants reply to the TMO defence last week indicating that I want to proceed with the case, and am waiting for acknowledgement and further instructions from the court...so I'm just sitting waiting.....0 -
The court will not have information regarding their viability, and will process cases as usual.
Thus claimants may still get notices from the court regarding submissions/hearings/judgements etc.
In view of the latest developments paying out any more money for hearing fees/warrants as well as postage costs for sending in any more claims etc need to be thought about!
(Their notice says their difficulties are essentially due to them not getting paid commission at the end of last year - though this thread is evidence that they have had to be squeezed hard to pay anyone for much longer than this)0 -

Hi, yes the £55 fee has now been debited from my account. Fortunately with me, TMO didn't contest anything or defend my claim, they simply have not paid me my 5th cash back claim even though acknowledging and accepting it back in October.
Yes I guess it's a case of waiting now and hoping they still have some funds. Will post any outcome as and when an outcome arrives!0 -

Another cashback retailer in trouble
Another struggling online dealer has written to customers to tell them it is unable to pay them their cashback.
[FONT=Arial,Helvetica,sans-serif]The Mobile Outlet, which claims to have 30,000 customers and to have already paid £4m in cashback payments says it has run into trouble because sub-dealers and distributors are withholding commissions and payments owed to them. [/FONT]
[FONT=Arial,Helvetica,sans-serif]In a letter to be sent on Friday the management team states: ‘We would like to stress that we are attempting to resolve matters and the utmost will be done to ensure all customers receive any cash back due. [/FONT]
[FONT=Arial,Helvetica,sans-serif]‘We ask our customers to remain patient over the next few weeks whilst we are dealing with the non- payment of commissions. We will send out an email keeping customers informed and updated as and when we have anything to report.’ [/FONT]
[FONT=Arial,Helvetica,sans-serif]In a statement accompanying the letter, the management team at The Mobile Outlet claim they started their own cashback incentives following ‘visits which were made by network dealer managers, who openly promoted and encouraged us as a company to run with a 40% business model, even though our model was a lot higher.’ [/FONT]
[FONT=Arial,Helvetica,sans-serif]Mobile understands the retailer is owed in the region of £200,000 from a distributor and another retailer. [/FONT]
So networks should take responsibility then. Can we do anything to pursue networks to accept their resposibility? I am with T-Mobile. I reported the problem to them a while ago and requesting them to lower down my tarriff. But they rejected. I am currently in month 6. I am going to cancel my direct debit and stop using the phone. Any comments? Does this mean that I will breach contract with T-Mobile. We only agreed contract with the Mobile Outlet.0 -

Quentin thanks for your advice don't worry I transferred my 2 phones to a cheaper tariff way before Christmas. So the money I submitted the MCOL for is a one off. I've no intention of getting my fingers burnt again.
Which network are you with? T-Mobile don't allow me to downgrade. Thanks0 -

You will be chased for the money by T-Mob (who will add more to your bills because they can't collect on your dd).
They won't let you off, and will black mark your credit records.
