  • In the assumptions about how the Industry works their is another party involved and that is a Distributor.

    I am only all fry, but I have heard of some distributors holding on to money received from the Networks to pay to the Dealer.

    If a Distributor decides in their infinate wisdom to withhold the dealers commission then it can put the dealer out of Business and if they have many staff this can put them on the dole.

    I have just been paid for some Upgrades done in October/November to the Three network. I had to pay for the phones within 30 days but they have taken nearly 4 months to pay me. Apparently it was down to Three having a system issue.

    For high connecting companies this could easily put them out of Business.

    We should get paid within 3 weeks from the date the contract is taken out.

    Just another way of looking at things and I have heard that TMO have had monies owed to them withheld unfairly.

    ALWAYS use Special Delivery with consequential loss insurance for sending in claims, and don't leave it till the last minute....

    Indeed, I only started doing that after my 3rd installment after just using recorded delivery, I was lucky as they acknowledged those first 3, otherwise i'd have been well and truly !!!!!!ed !!

    Just an update to my 2nd MCOL after my 1st successful MCOL, where i'm claiming for my 3,4 and 5 installments in one go, after the claim was issued on 21/1/08, today after no defence by TMO, the judgement by default has been issued today, and think I will get cracking with the warrant, as dont think the judgement will do much !!! I waited last time a week before proceeding to the warrant, but as I stated payment immediately, think I can proceed straight to the warrant ....

    Updates as and when !

    Jas is going to be so popular in the courts!!
    It may be of use building up a dossier on the lies this 'supervisor' has told.
    I think it would be difficult to use print outs from a forum in court but a few pms should be able to get some witness statements as to Jas' storytelling for when it actually goes to court
    Anyone willing to sign a witness statement identifying a lie by the company, please can you PM me. I am going to court in March as they trying to get judgement set aside ("they never recieved the court paperwork"). I want as many statements as possible where they have said the same thing (amazing how bad Royal Mail is at losing their mail).

    KLTPZYXM - After I informed Northampton Court that I wished to pursue with my case (despite TMO's defence and post-dated cheque) it took me AGES to receive a response from the court. After several weeks of chasing calls, it finally got moved to my local court who wrote to me saying they were waiting for another response from TMO. Again, following many weeks of chasing calls to my local court, and being told that TMO had failed to respond to further communications, I was told that my case was being referred to a District Judge who would determine a court date. The time-lag between me informing Northampton that I wanted to proceed with my case, to the date when my Court Date was set, was about 10 weeks! I now have a court date set for early March.


    What happens at my Court Case?
    Assuming that TMO does not turn up, do I actually have to present any kind of case, or do I simply win by default?
    I'm not sure how much effort I want to put in to gathering all the documentation and preparing the case etc., if it will not be needed at the Court.

    Also......if (when!) I get judgement in my favour, it sounds like there is still minimal change of getting funds through a bailiff. Is that true? If I instruct a bailiff, do I need to pay them up-front, or do they simply recover (or attempt to recover) their costs from TMO?

    Is there any other method of recovering money from TMO through the courts? eg. If I mention to the judge that other peoples' attempts to recover money through bailiffs have not succeeded would he be able to offer any other method?

    If the defendant does not attend the hearing you don't just win by default.

    You still need to present your case to the judge, who will take into account anything the defendant has said in any written defence when making the judgement.

    You pay up front for a warrant to get the bailiff involved (£55), and this is added to the amount you have won judgement for. The bailiff then goes after the total you are owed.

    Read up on third party debt orders for another way to enforce a judgement (still costs £55, and really much more involved than a warrant - eg you need to supply the court with details of an account with money in it belonging solely to the defendant.)

    I've won judgment, but before I throw good money after bad and waste another £55 to issue a warrent, can anybody give me the contact details for the bailiffs please. I've looked through this forum, but I can't see it, this must be one of the longest forums on moneysavingexpert.:money:

    Correct me if i'm wrong but isn't the contract with TMO at the address shown in the original T&C's the one we have the contact with?

    I believe that they have moved offices once before... keep a eye out to see where they spring up again..(hopefully:confused: )

    Another cashback retailer in trouble


    Another struggling online dealer has written to customers to tell them it is unable to pay them their cashback.

    The Mobile Outlet, which claims to have 30,000 customers and to have already paid £4m in cashback payments says it has run into trouble because sub-dealers and distributors are withholding commissions and payments owed to them.
    In a letter to be sent on Friday the management team states: ‘We would like to stress that we are attempting to resolve matters and the utmost will be done to ensure all customers receive any cash back due.
    ‘We ask our customers to remain patient over the next few weeks whilst we are dealing with the non- payment of commissions. We will send out an email keeping customers informed and updated as and when we have anything to report.’
    In a statement accompanying the letter, the management team at The Mobile Outlet claim they started their own cashback incentives following ‘visits which were made by network dealer managers, who openly promoted and encouraged us as a company to run with a 40% business model, even though our model was a lot higher.’
    Mobile understands the retailer is owed in the region of £200,000 from a distributor and another retailer.
