    But I couldn't understand why networks do not want to take any responsibility. From the report, the Mobile Outlet mentioned that "says it has run into trouble because sub-dealers and distributors are withholding commissions and payments owed to them". This means that networks have some how contribute to the problem.
    It also claimed "they started their own cashback incentives following ‘visits which were made by network dealer managers, who openly promoted and encouraged us as a company to run with a 40% business model, even though our model was a lot higher.’"

    Network dealer managers "promoted and encouraged" thier business. How can networks claim that they don't have any responsibility?

    My 2 contracts were both for 12 months with 3. My 5th unpaid cashback claim for each was the end of the contract for both. I rang 3 direct and kept the 2 phone numbers, and merely pay 50% (approx) less per month for a similar deal to the previous one taken out using TMO as the middle man. Hindsight is a wonderful thing!!! but at least I wasn't locked into a ridiculous contract for months. :o

    Well the cashback isn't really anything to do with the network, so they can and will deny all knowledge & responsibility. Plus that statement might not be 100% true...

    My problems with the statement are:
    "Unlike many companies we have always complied with the networks code of practice incl the 60 day redemption voucher return" - they only introduced this quite recently, so not ALWAYS as they state!

    "majority of our customers do comply and are happy with their phones and cashback" - lol!

    "over the last few weeks we have received complaints from customers regarding the status of their cash back" - try the last few months!!!
    Wondering how to have a life & not rack up more debts...
  • I think T-mobile are one of the better networks for being understanding and downgrading your tariff, I've done the same when I had my fingers burnt with a different company going bankrupt
    2p off is still 2p off!
  • Although I have commenced court proceedings I have just phoned the 0871 number and got through to someone with a very heavy accent (possibly in a call centre). After giving the order details and explaining that I was still waiting for payment of my second and third cashback instalments I was told that the second was paid on 28/11/07. The guy even gave me a cheque number.
    When I challenged this, mentioning that a lot of people seemed not to have received their cheques (I intimated that whoever had put the info on their system was a liar), there followed an exchange (he was also speaking to someone else in the background) which ended when I was told that I would receive a 'replacement' cheque for the second instalment and payment of the third instalment. I told him I would not 'hold my breath' as I didn't want to die! Let's see what happens but I am not overly optimistic.
  • 1st post but been watching these posts for a couple of weeks. i too am owed cashbacks by MO on 2 seperate contracts.
    Just as zvichaim i was told cheque had been posted which failed to arrive, was told a second cheque would be raised and was given a cheque number, this suprisingly failed to arrive. despite many e-mails to various addresses i have not recieved any response since 21st november. i sent my cheque for £55 on saturday for baillifs, but this looks to be dead money as well now. so so frustrating as my wife also got caught when phonebox direct went bust on her contract in december.

    Maybe a dumb question, and possibly academic now, but if we've been granted judgement in our favour, does this mean that the contract with TMO is now null and void and that I'm free to downgrade my contract.

    Sorry - should have been clearer in my original post.

    Orange have already said that I can downgrade – in fact they suggested it after a standard review of my account usage. But TMO contract states that if you downgrade to a lower tariff during the contract your entitlement to cashback is null and void.

    If I have judgement in my favour for the full cashback covered by the contract I assume that TMO can no longer hold me to this condition and I’m free to downgrade.
