Hey. I have sent of bills 1-4 and 5-7, fully sticking to the terms and conditions but have only received confirmation that claim 1 was a success.
This seems to be the pattern - the first claim might get paid out as it is relatively small amount compared to the other claim submissions i.e. for 4 months bills you only get one fifth of the total - then the second one is effectively ignored and when you eventually chase it up they claim they never received it or received it late or the bills weren't original or *insert lies and excuses here*.
The latest extension of the scam is to acknowledge the first claim and then when you get to court action maintain that the first payment was made even though it wasn't - a backdated cheque which mysteriously never arrives ...... and there is no notification of it ever being sent. In fact all communications with them dry up so you've no idea whats happening and start wondering if it was you who missed something.
The result of all this delay is that the commissions paid from the phone cos pile up and generate interest for the scammers. How much cash do you think they are sitting on ... anyone in the know prepared to hazard a guess .....0 -

The last accounts filed at Companies House show cash of well over £1 million in their bank account. Shame they wont give any of it to us!0 -

So The Mobile Outlet hasn't gone bust (yet)?
I received my 1st claim ok (late, but at least I got it), confirmation of my 2nd and 3rd (although repeatedly promised payment, it never came) and my 4th and 5th were just ignored. I've sent everything recorded delivery, so have proof they received my bills. I'm just about to send back my final bill.
I had threatened to start proceedings against them (and have heard nothing since), but thought I might as well wait until I could do it for all the claims (although from reading through this thread, it seems that once they had broken the contract, it no longer mattered).
Now I am in that position. Should I send a letter with my bill informing them that unless all the remaining cashback is received within 28 days as per their terms and conditions, I will issue proceedings against them and then actually follow through 'till the bitter end with bailiffs etc should it not be forthcoming?

Yes that exactly what I did yesterday and my claim has been accepted and issued However the correct name is:

Not entirely correct (if I may say so). Following my post number 2156 (on page 108 of this thread) and the lack of definitive answer from the forum, I have e-mailed MCOL on Wednesday evening and have had their reply today.
My e-mail:-

I am making a claim against a company who owe me money.
When I took out my contract with this company they had a trading address which is different to their registered company address.
I am aware that they have recently moved from their old trading address to a new trading address, even though they havn't altered their trading address on their web site.
I believe that they are having mail forwarded from their old trading address to the new address, but I do not know for how long this arrangement is in place.
In step 4 of 8 on the MCOL application I am required to enter their address.
Please advise which address I should use:-
1) Their old trading address when I took out my contract with them
2) Their new trading address
3) Their registered company address

Their reply:-
Thank you for your email. Please see the claimant's user guide on the Money Claim Online website. Under the section 'starting a claim' there is a paragraph about entering a judgment against companies. It states that you can use any address that the company currently trade from as long as the address is in England and Wales. As long as it is the same company you do not have to use the address at which you traded with them.

Hi All
Just back from visiting TMO at Bradford arrived at 0920hrs and spoke to TMO rep ref my claim stating that the first claim was due on the 22 Nov 07 and that it had not been paid i had tried various means to contact them as to why my claim was taking so long, I informed him that i had my secound claim with me and that payment was due on this, I also told him that as they had broken the contract i wanted the full amount of cashback. I also showed him a copy of my notice to Issue ( Issued by thecourt)that i taken out. I told him that i required a cheque for £480 otherwise i would continue with my claim against them. I was asked to come back at 1500hrs and my cheque would be ready to collect.
I arrived back at TMO at 1450hrs and spoke with another TMO rep who brought me an envolope sealed with my cheque inside (They seemd a bit on edge) Not suprised as when i opened the cheque in front of them it was for £96 and not the full £480. not even the amount they owed me for my first cash back that was £160.00, I infromed them regarding there contract and that they had broken it , i was told that they would only pay me in 5 x £96 instalments, I refused to take the payment has this may of caused problems with my claim for the full amount. Oh by the way he informed me that they always pay on time. It looks like they are wise tio people visiting them and are now not paying out the full amount owed. Also they have 3 suites at Valley parade but once you sign at the front desk (Lady does not work for them and is very helpful she will tell you that between 5 and 10 people are turning up during the week and most of them are not getting there money)
You have to wait in the corridoor as they will not invite you into the offices.
I also visited the old offices in Shipley which is now a car sales room and customers of the TMO are turning up there as well. PS they should be reciving my claim that will be deemed as served on the 28th Jan 08.0 -

Hi all,
I bought a phone in Sep 2006 and have so far received 4 out of the 5 cashback claims. I have just filed a claim with MCOL for the final stage of my cashback which was received and accepted by TMO on 7th Sep so the payment is now 16 weeks overdue
