abbica,
a few pages ago you will find posts that explain in detail how you have a contract with Mobile Matters Ltd, trading as The Mobile Outlet. You are referring to a company called The Mobile Outlet LTD., who are completely unrelated. HTH.......Gettin' There, Wherever There is......

The cowboy, rubbish company (The Mobile Outlet) is in trouble at the moment. It is because there are so many compliants from their customers about the cash back claim. But they never care about it, even though you let them know you've already spoken to Trading Standard, Consumer Direct, Watch Dog and Small Claim Court. In this case, I beg they are running out fund. And also they are facing lots of problem from their customers. The only one thing they would do is close down the business soon and run off. That means they don't need to pay cash back and don't need to attend court hearing.0

Hi,
Sorry to keep bleating on about cashback! I've worked out that my 1st cashback claim hits 120 days on the 6th of Feb. I notice that the 120 day rule means you have to send your bill right before the next bill is due (i.e I'm always billed on the 10th of the month). Does that mean I sent my Jan or Feb bill?
Also, I notice from the website T&C's that it says that number porting isn't available to o2. I originally ordered a T-mobile package but was told that wasn't available so they offered me the o2 deal. I specifically asked the process for porting my number & said I could do this by getting the phone & then porting my no & cashback would still apply. Have I !!!!!!ed myself?
Thanks in advance!

Just been talking to Bradford Bailiffs. Surprise, surprise - TMO have put in an application to get the judgement set aside - "as they never received notification of it". Bradford bailiff says that they have never won a case so far, and they don't look like they are going bust "for now".
I know that previous posters have recommended cashback claims & MCOL claims should be addressed to the Shipley address.
Bearing in mind that TMO are using the excuse that they have not been notified to have the judgement set aside, for MCOL claims only, is it advisable to use either their new Bradford trading address or their registered company address?0 -

I can prove that they have mail redirection, and in any case, the Shipley address is the one they still quote on their commercial website. So I do not believe that they can credibly argue that they did not receive the notice because it went to the wrong address.
I don't know if their excuse will be that it got "lost in the post". However, I sent them an e-mail giving them notice of the action, and another warning them I was going to obtain a warrant. They didn't bother to contact me after any of my e-mails. So I expect the courts to take a dim view of their application.0 -

thanks for your reply.i still don't understand who i am complaining against - is it mobile matters and not the mobile outlet? And how can these people still have an active website when they have put in a proposal to strike off? is it worth the hassle of trying to get money back though. don't know if i can cope with the stress or just put it down to a lesson learned the very hard way. they do owe me a lot of money though.0 -
I appreciate your reply Fagun, but I'm trying to fill in MCOL forms tonight and want to get it right to avoid ending up in the same position as you where they attempt to have the judgement set aside, further delaying making payment.
Any further thoughts on the correct address to use for new MCOL claims?0 -
abbica - your claim is against "mobile matters ltd. trading as The Mobile Outlet", unless I'm very much mistaken...........Gettin' There, Wherever There is......

My MCOL claim was due for judgement today but has gone to defence - date April 1st who's fooling who !! - the defendant disputes the whole amount claimed. "The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly."
All claims have been sent in on time spec del as required, TMO have simply not even acknowledged them.
Very amusing the games these people play!!!0 -

Not a fun game though, you now have to take time off work to attend court. I understand that the costs you can claim when (if) you win are minimal.0
