Went to Court on 4 Jan and won. TMO didn't turn up. Got full years cashback + expenses!
TMO given 2 weeks to pay, and guess what? They haven't so will be applying for enforcement tomorrow.

Travel costs to the court plus loss of earnings (max for this is usually just £50).
These are not part of the original claim. You ask for these on the day of the court hearing (after you have won - if you lose, then the defendant claims expenses off you).

Over 100 pages and I've read most of them.
What I have yet to see is someone who has sucessfully got their money back by using the Bailiffs after their MCOL.
Also on the new tactic of not handing cheques out there and then, and showing one filled in awaiting signature.
So how about it forum posters - has someone who has had their MCOL judgment for a full year actually had the cash IN THEIR POCKET, not on a piece of paper saying its with the (frankly weak and not that bothered) bailiffs.
I am nearing the point of which way to go - call at offices, or LBA and MCOL.
I was pushed to thinking calling was the solution, but if that has now been headed off by TMO then I need to know the true sucess rate of MCOL before throwing good money after bad.
If all else fails I need to get onto the Network providors and beg to be shifted to as cheaper tariff.I didn't do it, nobody saw me do it, you can't prove a thing!

It has been reported.
But no-one recently has reported getting (and clearing) a cheque from them.
With all the postings recently showing they ignore ccjs, it might be worth holding off on paying out any court fees until we hear from someone getting paid via the bailiff.
If you start legal proceedings today, it does look you have to go all the way, paying for a warrant, and this makes it a long process - at least 2/3 months, and from what we have heard much longer.
The way they are happy to let the ccjs mount up against them, will they be here in 2/3 months?0 -
Just wondering if anyone knows the opening hours/days of TMO's (valley parade) office as I'm planning on going down on a saturday if possible.
Also, someone said they were supposed to be sent a cheque the following day after visiting their office...did this ever appear?0 -
Oxheys posted on 17th Jan that his cheque had cleared. Mine was supposed to be put in the post on Friday so I'm giving it a couple of days before I go back.0

Hello all, another new member here. I discovered this thread/forum at the weekend. I'm in the same boat with 2 contracts, received 2 cash backs on one and 3 on the other. Both contracts are overdue the remaining cashbacks. I have sent the LBA by post & e-mail - no response received so far. Due to commence MCOL on Wednesday.
I would appreciate further comments from other members in the next couple of days:-
