  • have not even received the cashback vouchers yet after phoning them at least 3 times over a 2 month period. they keep saying it'll arrive "within 3-5 business days".

    What should I do? Can I sue them now?

    Hi,

    I was (and still am) in exactly the same position as you. I was advised (by Trading Standards) to write them a letter (send it recorded) explaining that they didn't send you any vouchers and to send them within the next 14 days, then wait 14 days and if you don't get a reply then when it is time to send off your claim include a covering note saying why you haven't included the vouchers and reference your letter dated whatever date. Obviously eventually you will need to file an MCOL claim, and when it gets to court and their excuse is "You didn't include the vouchers" then you can show your letter to the judge and quoting the man I spoke to at Trading Standards "no court is going to say that you didn't do everything you could have to try and get the vouchers" :)

    That is my plan of action, anyway.

  • They owe me £168. Claims 4 & 5 approved but not paid.

    They will probably go bankrupt when the Nintendo Wii's they offered for Xmas aren't delivered. This will probably be March as people have to send in their second bill and wait 21 days I believe.

    The serious fraud office removed their computers a couple of months ago and the directors sort retreat abroad. They returned but keep heading up to Tyneside to avoid public attention

    The reason I have not filed against them is that the £25 would be wasted when they go into administration.

    One guy went to Valley parade and demanded a cheque. He received it but I'm not sure if it bounced or not.

    I've already lost out to Coolnewmobile going bust and I've collected a lot of facts on the Mobile Outlet to see if it's worth pursuing this lot. Most of the networks have stop dealing with them and I they have very little time left as they owe many thousands.

    Personally I've accepted the very sad fact I'll never see the money again.:angry:

    From where are you going ... I am in Southwest i.e. Bristol if possible we can go together

    I had a judgement made against them in my favour of approx £350. I'm a bit confused as the court gave them 14 days to pay. But this thread in places suggests I don't wait the 14 days and should instruct a bailliff right away?

    Don't apply for a warrant now then as it will be refused in the light of the courts instructions giving them 14 days.

    Wait the 14 days and if they have ignored the court order apply for a warrant to get the bailiffs involved. (At least you will have another 14 days of feedback on whether the £55 for the warrant is worth the gamble).

    (People getting the bailiffs in immediately have done so after winning a judgement ordering them to make immediate payment)

    I ordered my mobile from themobileoutlet on 6th October 2007. It's a 12 month contract & you have to send in vouchers. It arrived, and my bills started coming. I get a bill dated 11th every month & the network is paid 1-month in advance I think as I got my 1st bill a couple of days after I was connected (or was it for a partial month!!??!!)

    Anyway the 120 days for me to claim my cash back has either arrived or is just about to. Do the boffins amongst you reckon I send in the bill I got in January or February to get the spondolix? I'm sooooooooo confused!!

    Any other hints/tips with TMO would be much appreciated!
