    They're cheaper than driving from one end of the country to Bradford, and back again. (The defendant has to pay their charges).
  • Where does it say in their T&C's that they have to pay the cashback on when?
    The only place that I can find in my T&C's is the 5 stages of cashback - within 21 days of date of bill (EG) 4.

    That 21 days was the time allowed for you to get the claim in.

    Check out condition 11:
    The payment is paid in 5 equal instalments by BACS directly to the account details provided at the time of your order. It is paid within 45 working days of our receiving your claim

    How quickly are people getting their money once instructing bailiffs?
  • Update - Just spoken with T-Mobile customer services (ref: saleman Robert 753). After lecturing me on the subtleties of case law, he advised the following:
    1. The statement of the back of the latest bill was a 'misprint'. He can't be legally held to it- so he tells me.
    2. Although they did renegotiate plans in 2007, the policy apparently changed in December. They have washed their hands of it and will no longer renegotiate anything.

    They are holding me to the contract. They sold their product to a company with an unsustainable business model and wish to have nothing else to do with it. Shocking :mad: .
  • Having a cashback contract with mobile outlet for claiming in 5 stages I have successfully been payed 2 of the cashback although cash back took more than 12 weeks to pay.

    Cash back 3 got delayed due to postal strike, but sent paperwork within relevant timeframe (proof provided) sent letters but no response.

    Sent remaining cash back 4 and 5 ontime but no response as a letter stated that the whole cash back will be void.

    Please advise if mobile outlet will request payments of cash back 1 and 2 from me which they paid? as I no longer want any hassle from them.

    They should also pay cash back 3, 4 and 5 as this was ontime? they can't stop all cash back due to one late cash back? (unfair contract)

    Please help and advise.

    1) The cashbacks you have received are yours to keep. They cannot request them back.
    2) You may be on sticky ground for the late arrival of No.3. They will argue that its not their fault and its your responsibility to get it to them on time.
    It's always worth arguing the case with them though.
    3) if you lose the fight for point 2 above then your final claims are also void I'm afraid.
    Thats my understanding of the contract aanyway. If anyone else out there knows otherwise please post on this threead.

    read page 65, 66 on this thread.

    There was someone who had a similar case as yours. When they forwarded the bills to TMO on time however TMO received it late.

    In TMO T&C they state that bills should be "forwaded" within 21 days. They didn't state that they should be "received" within 21 days. As a result you will need to make a claim on MCOL for your 3,4,5 cashback claims as you may have a chance of winning.

    What exactly you need to do is detailed in page 65,66.
  • Just had an interesting conversation with someone from Lifestyle Insurance. They had taken a payment for a phone I got from TMO in November (yes, I know now!) even though I thought I had cancelled the insurance and have not had any paperwork about it. She said there had been a delay getting info from TMO as "part of the company has gone into liquidation". Now it could be that she, like many on here, had got the wrong compnay but it seems unlikely. I pressed her for further info but she was not forthcoming except to say that they are still working with TMO.
