Interesting....just today I have had a debit of £5.95 taken from my bank account by Lifestyle - I called them up and was surprised to find that this was for insurance I had apparently agreed to when ordering the phone through TMO.
I cannot prove otherwise but I would not knowingly have agreed to take out the insurance. Very strange.........
Anyway, I've cancelled it now.0 -

If you contract was taken out after the 31st July 2007 then it is T-Mobile's responsibility to ensure that TMO had reasonable claims such as not expecting you to send cashback claims in less than 60 days in their terms and conditions, which of course we know they didn't.
However, if you bring this up with T-Mobile and they say it's not their problem and nor was it, you can use this as bargaining power for them to give you a lower tariff etc. And if they still insist that it was never their problem you can take it up with OFCOM.
If you want to read it yourself the document is called "Code of Practice for the sales and marketing of subscriptions to mobile networks" and you can supposedly get it from all the major network providers websites or the OFCOM website, but googleing around will probably find it fastest.
I got a letter from O2 saying that they would be looking into my claim, so I've requested that they keep me informed in writing.
Also, unrelated, I am preparing to send of my first claim, just waiting for the bill to arrive. Fun fun fun.

Hi - like most of you we are in dispute with the Mobile Outlet. We have 2 current contracts via TMO - one with T-Mobile and one with Vodaphone. We have MCOL claims in on both contracts but thought we would try the service providers as well to see if we could reduce term, tariff etc if MCOL fails. Today we got a reply from both providers. Vodaphone was sympathetic (!) but said "it has been brought to our notice that the Mobile Outlet has been placed into receivership". They then went on to say that they did however have a "team" looking at issues with cash back dealers and that someone would contact us to discuss. T-Mobile basically said its nothing to do with them and they would not change the contract without penalty. They did though say that they also had a department which oversaw the activities of dealers and would like some further info without any indication that we might benefit from this exercise.0

Hi... I'm in need of a little help as I have managed to confuse myself about my mobile cashback deal!
I ordered my mobile from themobileoutlet on 6th October 2007. It's a 12 month contract & you have to send in vouchers. It arrived, and my bills started coming. I get a bill dated 11th every month & the network is paid 1-month in advance I think as I got my 1st bill a couple of days after I was connected (or was it for a partial month!!??!!)
Anyway the 120 days for me to claim my cash back has either arrived or is just about to. Do the boffins amongst you reckon I send in the bill I got in January or February to get the spondolix? I'm sooooooooo confused!!
Any other hints/tips with TMO would be much appreciated!

Hi people,
I have been reading this forum for some time now and ensured all my claims were sent in accordance to the tanc's.
I received my first 3 cash back (obviously not on time). And my 4th and 5th claims were also successful.
My 4th cash back was accepted on the 16th October and my 5th cash back was accepted on the 20th of November. It is now the 19th of January.
I have not received payment for both the claims and it has been over 3 months since my 4th claim was accepted (4 months since i had sent it).
I would APPRECIATE ANY HELP AND ADVISE as to what i should do. I have emailed on a weekly basis to 3 of their different email addresses, but have had no response.

Send LBA (template posted in earlier pages) giving them a final chance to pay.
Then file MCOL claim after LBA deadline has expired.
You will get a letter from the court advising when you can ask for a judgement (14 days after defendant receives the claim, unless they respond to the claim).When you ask for a judgement, ask to be paid immediately.
The day after you get a judgement, get a bailiff as TMO will ignore the CCJ.

That 21 days was the time allowed for you to get the claim in.
Check out condition 11:
I must have a different set of T&Cs to you Quentin as it says at point 11
'Once we are in receipt of your original documentation, please allow 28 days for delivery of cheques.
They dont mention paying into the account given at the beginning just sending cheques off. As my 1st cashback was due after 24/10/07 then I think that they are a little late dont you?
Time will tell what will be the final outcome....

There are lots of different ts + cs around.
Generally clause 11 is the cashback one.
Doesn't your 28 days answer your question, though?0
