You may not want them to identify you as being fagun from mse. (Which they now can).
If not you can edit your post.0 -
Thanks for the concern, though I don't htink it really matters since I already have judgement against them and am trying to get them to cough up. Question is, is it worth paying for the bailiff (as you quite rightly pointed out on Monday)? You may not want them to identify you as being fagun from mse. (Which they now can).

I claim against The Mobile Outlet Ltd. not Mobile Matters (U.K.) Ltd. and have used the Riverdale, Shipley address in my claim on MCOL. I have just submitted a request for judgement by default yesterday because The Mobile Outlet has not filed any defence back. I rang the MCOL today to see if I can change the address. She said I can only bar it or let it go through if I’m sure that I have used the correct address as the defendant can get back and say the claim didn’t serve them properly. So I decided to go ahead because I don’t want to start everything from the beginning again and it’s not my fault that they changed their address without telling us. Also as I claim against The Mobile Outlet Ltd. not Mobile Matters (U.K.) Ltd. Does anybody think it would be a problem? Should people claim against Mobile Matters (U.K.) Ltd not The Mobile Outlet Ltd.?
Anybody has an experience once the Judgement has been sent out how long does it take for them to send a cheque through? Should I send out a warrant? Can I change the address to send out warrant? No reliance should be placed on the above.0 -
Now we're getting close to 100 pages I think we need some kind soul to consolidate all of the useful info in this thread into a new thread. It seems that every page now has numerous people asking for help and numerous replies telling them to read the thread and it's not going to get any better as it balloons ever larger. You are contemplating legal action, but cannot find the time to read through this thread which will give you all the advice needed (free).
Don't start on the legal route without doing some homework and preparation.
Read the thread and the MCOL claimants guide.
I would offer but don't have the time at present.0 -

Some answers
LBA does not need to be on formal paper. If you purchased the contract over the internet, the e-commerce directive gives you you the right to communicate to them using their published e-mail address(es) rather than by mail. So you can send the LBA by e-mail with a "receipt" request. Their e-mails have an automated "holding" response, so an easy way for you to prove that they received it.Question 1: An LBA, can I just write that letter or does it have to be an official document and if so who does it or where do i get it? If it is something I write could anyone send me an example of what they have written?
Probably upto the judge to decide, though Q3 suggests they falsely rejected your 5th claim.Question 2: I had 2 contracts one for myself and one for my husband, both in my name with the mobileoutlet. Now my 4th claims were accepted for both contracts back in septemeber 2007, but not paid yet.
Do they owe me that even if they rejected claim no.5 or does that get invalid as well, even if previously accepted?
Not sure I understand the "first class recorded strip" comment. If it was ent recorded delivery, you can obtain electronic proof of delivery from the Royal Mail website. A proof of posting certificate would be persuasive evidence (though upto the judge to devide).Question 3:
One claim got rejected because I was apparently late, but I have a first class recorded strip that it was sent after 10 days of the issue date of bill no. 12. Is that sufficient for the court?
The other claim got rejected because I downgraded. However I downgraded with effect from 17th october and my contract ended 16th of october. My line rental provider have sent me a letter welcoming me to my new downgraded contract that starts on 17th october, is that sufficient proof that I have not breached their contract?
I think so, since you are trying to put claim for all amounts due. However, you should check with the MCOL helpline. Also, don't forget you need to put in relevant detials of both contracts - which is hard to do online because of the limited number of characters you are allowed.Question 4 and last!:
If I go file a online SCC can I file both claims of my husband and I in one claim evenb if its two contracts as they are both in my name or do I have to pay 30 pounds twice and do two claims.0 -
Question is, is it worth paying for the bailiff (as you quite rightly pointed out on Monday)?
It does seem from others who have won ccjs against them that they take as much notice of a ccj as they do of lbas, e-mails, letters, etc.
Though James212 did report the bailiffs succeeded for him back in November.0 -

I typed in The Mobile Outlet Ltd in my MCOL form and I have submitted the request for judgement yesterday. Does it mean even I won a judgement MBO can ignore it because I type in the company name wrong? What would be your advice? Do I need to cancel the existing claim and submit a new one?
Many thanksNo reliance should be placed on the above.0 -
You should probably ask the MCOL helpline this question.start_to_B_smart wrote: »Quentin

Afraid they do have grounds to ignore it. Just as you would if a ccj arrived at your house addressed to B smart Ltd, when no such company by that name lives there.
There is another separate limited company called The Mobile Outlet Ltd which is a separate business altogether.
I fear you may have to start again.0
