Im in the same boat as the rest of you.

I have got my first 2 claims but not my 3rd, 4th and 5th, which was only submitted 3 weeks ago.

Im going to go down the same route as everyone else and going to send them a LBA then court proceddings.

Has anybody been successful in getting back their money through the courts yet??

    Thanks

    I too have several contracts with these cowboys, and would like to know this;

If I have the e-mails confirming both receipt and acceptance of my claims from August and September last year, and of their stock reply e-mails when I queried it, along with evidence of the claims they DID pay out earlier in the year, can I make a claim on MCOL without much else in documentation.

They never send me back my bills even though I send them a SAE (thieves), and last year there were no 'claim certificates' to send in. I didn't keep my RD slips as they've confirmed receipt.

As for this years contracts, I have 3 of the damned things with them coz they paid out so well last time. I'm coughing £120 a month out and so far am only up to claim 1 on 2 of the contracts being 120 days in (the third is due on the next bill). I sent these RD just b4 Xmas and so far they haven't even acknowledged them.

When I do the LBA for these, do I do 3, and can I then combine the debt on the 3 contracts in 1 claim (or 1 judgement which is what I am seeking) - I am thinking it is the latter as would be the case if a supplier of stock were to sue a customer - it would be for several invoices not just 1.

What chance do I have of the Court defaulting to the full year's amounts?
I didn't do it, nobody saw me do it, you can't prove a thing! ;)

I wonder, is there a way using these forums to put a 'vote' up to count the seperate number of LBA's and MCOL's going on right now - I know it only applies to those who read these forums, but I'd find it useful evidence to take to the Court.

Also perhaps one to count who has had the 'cheque sent' excuse with photocopy's produced for the Court (to stop it being accepted so readily).

Knowing how many others have written letters to them or issued claims against them would have no bearing on your case in a court hearing. (Which would be decided on its merits).

I made my claim throught the MCOL yesterday, for the full amount.

    Fingers crossed!

Managed to get my claim through to MCOL today (pm) but when I printed the page that MCOL recommends, I noticed that the claimant is me but Im also listed myself as the defendant as well

Can you guys PLEASE tell me if this will affect my claim in any form as it took me so long to get it through that I must have made a typing mistake. I will contact MCOL helpdesk tomorrow to check but surely this wont mess it all up for me will it:confused::confused:

    woodie100,
the helpdesk should be able to sort it for you if you do ring them tomorrow....

You need to ring them first thing to cancel the claim - they will refund you by cheque. If you ring after 10.00 it will be too late.

    Then start again.

Hi, I am curious to know where you are going to send your LBA letter.
I live local to their offices (The Riverdale House, Shipley address) and the bad news is that they left there several months ago.
I know this for sure as I went there personally and spoke to the people who now occupy this address.
If you have a new address please let me know as they owe me two payments from last year and all payments for my current deal. All in all, I'm seven hundred pound out of pocket!
Sadly we are not alone, the people at the office said I was the 3rd caller that day looking for them.

    Hi,

I'm starting to claim against The Mobile Outlet on MCOL, does anyone know if the company is a plc, llp or ltd? I've looked on the website and on paperwork I have received from them but it does not say what type of firm it is.
    Thanks
    Sara
