  • Hi,

Wondering if anyone can give me some advice.

We have 2 outstanding amounts due to us (one each for me and hubby) - these are outstanding fom May 2007! We've chased a fair bit but no response. I consequently (without knowing about these problems) have purchased a further contract from them, the 1st claim is due next week. What's the score with these people? Am I likely to be out of pocket? If this is the case then Iw oudl want to cancel my contract with O2 as it's £40 a month and we only got it because of cashback!

Do you think O2 would allow me to cancel the contract given the circumstances? £40 is a lot to pay if you're only using Texts and voice calls!

No chance of o2 allowing you to cancel - your deal with them is seperate from your deal with TMO.

Read through the thread to discover "what the score is with these people"

...and as always heed the warning from MCOL about being happy the Defendant is able to pay before spending any more money on them in fees for the bailiffs.

Not sure how I can check that they are able to pay. They are still trading, and people are still taking out contracts with them.

I was lucky enough to have submitted my case before MCOL went down. I have obtained judgement by default, and the notice went out today.

So what next? How long should I give them before asking for an order of execution? Besides the Valley Parade and Shipley addresses, are there any other addresses I should inform the baillifs of?

I claimed for my full outstanding amount. Do I need to still submit the remaining bills? Or is the contract now cancelled?

Thanks in advance for any advice.

Hallelujah, i've managed to submit my judgement now too !!
TMO also have until Wed to respond to my threat of another LBA for my 3rd claim, and they are getting it sent on Wednesday afternoon, and this time the claim will be for the full amount as I will be sending my 5th and final claim this week, of what has been the most stressful 6 months of my life !! NO MORE CASHBACK DEALS - EVER !!!!! :(

It is hard to make a sound judgemnent.

It would help if anyone gets paid they posted about it (when it's cleared!)
  • Hi people I need advice,

I paid my fourth invoice on December 8th to prove ive been connected for 120 days, then i sent the bills the voucher and the despatch note to the cash back address and they received this on the 18th of December. since then I have not received a single email a phone call from them saying they have accepted my cash back, am I worrying to early or have they gone bankrupt and run of with my money???

Oh yes one other thing, I made photocopies of the bills and despatch note and everything but I seem to have "misplaced" them. First I wasn’t too bothered as I thought a court case will hardly take place. now that have read all these blogs, should I start to get worried as I won’t have any solid proof too stand on if they accept to go to court.

    Thanks

I have friend who said the cashback company that was helping (or not helping in this case) went bankrupt and him being a student he couldnt afford it so he phoned 3 and told them in a really sweet and desperate voice and they agreed to cancel his contract. i dont know how accurately he told us the story, but you can give it a go. although your company is o2 so it might be a totally different situation, but nevertheless worth a try. Good luck.
  • Firstly, thanks to everybody for the advice. I have read and used them.

I had no money from TMO since July last year. Today, I got fed up with TMO and sent in a claim through MCOL. I made one claim for full cashbacks for three of my orders with TMO. The LBA was sent more than two weeks ago.

    Submitted MCOL @ lunchtime.
Time to sit back & wait....
  • OK so i've had a contract with these people since last march and i've followed the cashbacks to the letter sending the original bills to them.. so far 2 being paid at least 2 months late. I still haven't received my cashback from october which was my last claim where i sent the 2 original bills received via the post.

After this time vodaphone stopped sending bills through the post and only sent me them via e-mail .. so for my last cashback claim i sent them prints of these, about 3 days later i got the letter saying i had voided the contract and was no longer entitled to cashbacks.

what should be my next course of action i'm still owed one payment from where i sent them the original bills and what should i do about the fact that vodaphone didn't send me any postal bills after this time ?

    thanks.
