    I will be submitting my first MCOL if I don't get a responce. My LBA should be received today so they have 1 week.


    I have only submitted the MCOL for the 2nd cashback payment, I wasn't sure whether I would get the whole lot back in one go. Whereas by the time I file the next MCOL (which i will no doubt need to do), I will have submitted my last claim, I will then file that claim for the last 3. But i'd still like to see number 2 before talking about 3,4 and 5 !!!
    I will never do a 100% cashback line rental deal again, not worth the hassle and effort - FACT :(
  • I am awaiting a payment of £288 (3 claims, the first of which they received on 10.09.07). I have made numerous calls, sent e-mails & sent a written complaint. I get no response - this is the worst company I have ever dealt with in the last 10 years of having a contract phone. When I do speak to someone, they promise someone will call me back & they never do - I last spoke to the Asst Customer Services Manager - Enrique Peterson on 11.12.07 - he promised I would have receive all the cash back owed to me by 28.12.07 - guess what - no cheque, no contact!
  • From what I can make out from page 1 of this topic; you can only claim for the full amount i.e. all payments 1-5, if they have rejected a claim - therefore voiding all others. Up until that point they have only breached the contract for the payment in question. I myself have just written an LBA as follows and have sent it recorded delivery (so that I at least know when it arrives).
    For some reason recorded delivery to TMO takes 10 to 12 days and you don't always get a signature. I know the mail is redirected but I reckon someone in the PO is getting a bung!

    I have not received any reply or confirmation of my 1st cashback claim. The documentation relating to this claim was, according to Royal Mail, delivered on the 08/11/2007.
    I have not received my original Orange bills back even though I enclosed a SAE (as stated in your Ts and Cs) and will be claiming for the price of copies – currently @ £3 each.

    On the 14th of December I emailed you for confirmation of my claim – the reply said you would get back to me within 3 days – this has not happened.

    Under the Terms and Conditions it states to allow 28 days for the delivery of cheques from the date you receive my original documentation.

    If I do not receive the payment and original bills within the next ten days, I will have no alternative but to issue proceedings in the county court without further notice.

    If it is necessary for me to pursue this course of action, please note that I intend to claim for the amounts in full plus interest as you have breached our contract, as stated in your terms and conditions binding at the time of purchase, together with the court fees. I look forward to hearing from you within the next ten days.

    Please keep me updated on your decision by email as well as post.

    I guess I now wait the 10 days and start proceedings with MCOL and hope thay don't follow PBD into receivership. I had a contract with PBD last year and was paid out in full (eventually). I guess lucky one year not so lucky the next!
    I have read many informative posts on here and look forward to reading more as the months drag by, my thanks to all who take their time and help others on here with similar problems

  • Is there a way we can initiate any other legal proceedings against the company's directors as there are lot many people who have not been paid their claims and those who are sending MCOL notices get pre dated cheques, is there a government agency which can look into this company's work ethics???

    Before I read about the issues with TMO, I purchased a cAshback offer from them. This was in October 2007.

    How do I claim my cashback?

    hubby normally deals with this, but is away overseas at the moment, and I don't want to mess up!!!

    My reading of the situation is that by not paying any of your cashback claims on time they have breached their end of the contract and are therefore liable for the full amount. I'm sure someone in the thread has successfully claimed for >1 cashback claim because of late payments but trying to find it in the 86 pages of this thread is proving difficult.
  • I bought a mobile phone from http://www.themobileoutlet.co.uk/
    last April. The tariff of mobile phone is £35 per month, 12 months contract.
    According to Terms & Conditions, I can claim cash back five times, seperately the fourth month, the seventh month, the ninth month, the eleventh and the twenveth . I sent them Cashback Redemption Vouchers on time. Now I have already sent them three time cashback redemption voucher, that was the fourth month, the seventh month and ninth month. But they have never
    cashed back to me. I phoned them many time, but no one answer the phone.
    I sent the email to them. A long time late, they replied to say, they would give me cash back within 7-10days. However, one month pass, I haven't got the cashback. So what should I do. I didnt expect this company was a cheater. Who knows where I can complain this company.

    There seems to be a definite pattern of them paying the first 2 to lull you into a false sense of security then promising to pay the third & not doing- mine's the same.

    Well I'm still trying to get the 1st cashback paid from them dispite having acceptance emails from them:confused:

    When MCOL is back up and running (if TMO hasn't overloaded it that is...;)

    Will keep you all posted on my lonely bid to get sopme money back from them.:mad:

    Me too!! Just hope they haven't gone bankrupt before the court case.

    I hope to claim the full amount as this delay isnt acceptable. I have sent in 2 claims and received nothing, except for an email advising 1st claim qualified, but payment would be late!!
