No need to give any days of grace because of holidays - they would not give you any if your claim was due in to them during this period.
If you read the thread you will see that rarely does payment follow smoothly from a correct claim being submitted.
Start chasing the money now - if you are prepared to use the court to get your money, then start now by sending a LBA.

Thanks. I'll go down that route. TBH in 2007 I would probably have let it slip by, but I'm eliminating procrastination from my dictionary this year. 1591 it is.

MCOL website has become as bad as TMO's customer support !! They issued my claim to TMO on 7/12/07 meaning they had 14 days till I could begin the judgement process on the MCOL website (i.e. 21/12/07), however they took the website down till 31/12/07 . I've been on there 31/12/07 and again today, but keep getting an error message at the 4th out of 5th step when using the start judgement process, or I get the old website is down from 21/12/07 till 9am on 31/12/07 message !!! Even MCOL are trying to make getting my money harder now !!!! :mad:0

I actually managed to speak to someone at TMO on their new number and he said he will look into my 2 pending cashback claims which have not been paid and would get back to me. This was over a week ago (before holidays) but having checked today, nothing seems to have happened.
Has anyone managed to claim their cashback through LBA route?0 -
Balista, I think this was mentioned in an earlier thread- the MCOL service is not available until Monday 7th Jan due to site upgrading. I guess it will then be overloaded by TMO customers, including me, trying to get their claims in.
Psarinuk- which phone no. did you use? Might give them a final call before Monday.0 -

Yeah, gave them a call earlier, they said that. What a let down, I actually managed to get on there on 31st to start the judgement and it kept getting me to step 5 of 5 and then site kept coming up with an error. They suggested sending a request via post, but think i will just wait till Monday.
All this is for 2 of 5, my 3rd cashback was accepted and said it would take 45 days from receipt of paperwork, which was 20th November so they will be getting a nice little polite reminder tomorrow, before an LBA is issued before the week is out. Then its on with another MCOL claim if nothing comes of it. I'm going to be their best customer !:eek:0 -
my situation is more or less the same, im 19 year old student, got 2/5 cashback claim. been about 4 months since my 3rd one. the only thing is when i done special delivery i am not sure where the receipts are. i have still got them some where. just need to find them, they have accepted my cashback claim in email. 3rd one that is , 4th and 5th i dont think they are bothering with. i just wanted to ask as well as claiming for the cashback, if it goes through courts can i claim for compensation? my letter below. let me know if theres any way i could improve it, used a template posted earlier by a member (thanks).

CLAIMING FOR BREACH OF CONTRACT

Dear Sir/Madam,
I refer to previous cashback claim, which you had accepted on 2/10/07, concerning order numbers quoted above, to which I have received no payments. I write to advise that I will now proceed to claim the full amount of both my cash back due to breach of contract.
If I do not receive the full amount – “£252.00” within the next fourteen days of this letter, I will have no alternative but to issue proceedings in the county court without further notice.
If it is necessary for me to pursue this course of action, please note that I intend to claim for full refunds, as you have breached our contract, as stated in your terms and conditions binding at the time of purchase, together with the court fees as well as compensation for my time and late payment. I look forwards to hearing from you within the next fourteen days.
Please keep me updated on your decision by post.

There seems to be a definite pattern of them paying the first 2 to lull you into a false sense of security then promising to pay the third & not doing- mine's the same.0

Bailsta, from my understanding you have already submitted an MCOL? Why are you going to submit another? I thought you could submit your first MCOL to claim all outstanding claims due to them breeching their T&C's?
Perhaps someone with more experience can confirm?
I will be submitting my first MCOL if I don't get a responce. My LBA should be received today so they have 1 week.0
