  • I'm a little bit alarmed by this thread- does this mean mobile outlet is on the way out? I've already decided next time I need a new contract I'm going to take the plunge and actually try and find the cheapest rather than bother with all these cashback sites- it's worked for 3 years but is getting a bit risky now.

    My problem is, I've been living away from home at uni for the last couple of months and due to a serious oversight have just got home, checked my post and have 2 bills waiting to me sent off. I got my contract with them in March 07, so this is claim 3, months 8&9. However, the T&C say the claim has to be submitted within 21 days of the bill, and mine is dated 23rd November :( Do you think they might still give me the cashback if I stick it in the post now? Or if not, is there any way T-Mobile will reduce my contract? I still have 3 months left plus Nov & Dec = lots of money. I know this is how they get their money- I always prided myself on keeping on top of when to send them off!

    Sorry, but there is no chance. Because you haven't submitted the bill within the time period, you've essentially broken the contract. Therefore, the rest of the cashback is invalidated.

    T-Mobile won't reduce the contract as it's not their responsibility.

    At least you got some of your claims back. Hopefully you can get a better deal in your next contract. :beer:

    Of course you should pursue it.......you should get any costs back
    I'm in exactly the same position as you - TMO have told us our claims have been accepted....how can they argue against that fact in court???
    My LBA gave TMO until end of play tomorrow to cough up my last payment. I'll be filing MCOL on January 2nd if it hasn't arrived.

    BTW I sent the LBA to the Shipley address AND the Bantams Business Centre address posted by roadkilluk on Page 80, and a copy via email for good measure...

    Ey Up k !! and a happy festive season to you !!! I know you're right, and think I'll have to get my i's dotted and t's crossed in prep, and get LBA in post and e-mailed asap. Hang in there buddy, would be such a shame to fall at the final hurdle :D

    Hi all, Hope you all had a nice Christmas,

    An update on my position...
    3rd cashback claim has not been paid, submitted mid October but after polite emails and false replies saying will receive payment with 10 days etc etc etc, I have now returned from a week away and no payment... suprise suprise.
    A LBA has been sent recorded delivery this morning giving them 7 days to pay.
    My 4th Cashback Claim was submitted on the 10th December, unfortunately due to working nights and then going away the following day, I had to leave the Post Office run to my wife!!! I specifically told her 'SPECIAL Delivery' and yes you guessed it she sent it recorded.

    I have now sent the Royal Mail a cheque for £2.20 for proof of delivery (just using 'belt and braces' if needed for court), not heard acceptance yet off TMO.

    OK, I'm a little bit worried now as i have sent my first claim in November but never received an email to confirm that they have received it. I have a signature for the recipt though. It has now been 45 days since the receipt bt no sign of the cashback. I have sent verious emails and I think that sending a Letter Before Action is the way to go. Can anyone provide me with a template for this type of letter?

    if you read all the thread (which I suggest you do!), you will find an example of a LBA a few pages before this one........

    I received an email on the 29th October confirming receipt and all in order. They advised that I should have my cheque within 45 days. Still received nothing, despite several emails. I also had a contract with CNM so obviously I am concerned!!!

    I shall be claiming the full amount from them. Do you have to send a written warning! I sent an email to both email addresses giving them up to the 21st to pay. It seems pointless sending the letters as they are not being signed for (see previous posts)

    You need to send a LBA. Send it Special Delivery....
    I sent the LBA to the Shipley Address, The Bantams Business Centre Address (posted on an earlier page) and a copy by email.

    SD is a bit of an unnecessary expense for a LBA (even the court will use ordinary mail to post the summons off should it be necessary). And if the LBA works, there's no way you can get them to pay you any postage costs.
