  • I sent my letters (again) by Special Delivery yesterday, and the Royal Mail informs me that:

"We have tried to deliver your item from our SHIPLEY Delivery Office before 09:45 on 19/12/07 and we have left a while you were out card.

You can arrange a redelivery online, call the number on your card to arrange a re-delivery, or collect the item from your local enquiry office by bringing your card and proof of identification and address."

But why would they want to go and get the letter? And is them not going to get the letter grounds for me taking the case further through Trading Standards?

    Thanks for your help.

Why wouldn't they want their mail?

Trading Standards would not want to pursue them for not being at home when the postman called!

I sent my 4th cashback claim yesterday via special delivery after reading the posts on this thread about doing this, after sending the previous 3 just recorded delivery without any problems, and I too have got that message. Has anyone else had that before ? Tried to click on the arrange redelivery online, but got an error message. No idea what to do now...

It is not normally advised for claimants to contact defendants directly during the course of a case.

It is not for claimants to waste their time advising the defendant on what is or isn't contempt of court. Judges are well aware that not everyone tells the truth in court cases. (Both civil and criminal).

All contact with the defendant should have been done prior to issuing the summons.

Now (providing you are sure you have adhered to the conditions) just let the case run its course.

If the defence contains lies you can state your view to the court.

If they contact you to make an out of court offer which is less than the amount claimed you can simply ignore it (or accept if you want to, of course).
    Sorry, disagree with early points.

Point is that if persons at TMO are in contempt then the fact that they are reminded of, informed perhaps, might errrrr persuade them, as individuals, that they would be unwise to go before a Judge at hearing under those circumstances. They might then 'defend' less cases resulting in earlier judgement and hopefully satisfactory outcome for claimants.

I am not suggesting that you accuse anybody of wrongdoing. Simply point out that a false Statement of Truth is in contempt and refer them to the MCOL site. Then wish them a Merry Xmas and a Happy New Year.

TMO use the fact that individuals might be anxious about using the Court system and may back down as a result. Using the above might make individuals at TMO aware of the possible consequencs of being dishonest.
  • hey,

1)Part of the MCOL condition stated:-
your address for service must be within England and Wales.

I currently stay in Scotland. So does that mean I can't use the MCOL service? If so, where should I be going to?

    2) Can anyone provide TMO's full address and its suffix, whether it's a Ltd, Plc or LLP?
I've heard that TMO has moved their office to Bradford. So, which address do we use now?

3)Could anyone which has filed a claim before provide us with their "particulars of claim". English is not my 1st language and I need something as a reference.

Your help is much appreciated. Thanks.

Can I still make an online claim??
Send the LBA to Bradford address (but there is no mention of this new address on the site.0
""I am sure by Companies Act every registered company must has their registered address on the place of trade, buildign etc and I guess the website would be no exception"
Or Do I have to make 2 hour journey to see Attif hussain.

  • Maybe we should give them a group visit. I read somewhere that someone did so in Bradford and got the cheque from them as well. The Bradford address was also mentioned but I cant remember where I saw that comment and I cant find it either.
