I've sent my LBA via recorded delivery. When I keyed in the reference number through the royal mail webpage, it says it's delivered to Bradnorth centre. All is good until I click to view the electronic proof of delivery, it said that it couldn't display the electronic proof of delivery. To determine whether the recipient has received our letter, is the message stating that the letter has been sent to its respective centre good enough or do we need the electronic proof of delivery?0

Hi all, I've been reading this thread for a few weeks now and would like to add my experience (so far).
I have 2 contracts with them and they both have 5 payment cashbacks, as we know, we send our bills in correctly and they send out the payment (mine is paid direct into my account).
I have kept up to date with this and so far from March I have only had 1 payment payed back to me. I have phoned these people only to be told that there is a backlog and various other excuses.
I eventually got fed up with it all last Friday and as I only live 6 mile away from Shipley I decided that I would go over and pay them a visit. I printed out all my email correspondenses and gathered my 'proof of postage' and headed over there.
I found Riverdale House quickly enough and was told by 1-2 Riverdale House and also the garage behind that they are no longer at that address. Annoyed by this I decided to phone them, I spoke to chap named 'David' who had a very strong asian accent and asked him "Where are you at this moment? Where are you sat right now? Where are you and the phone you are using?". The reply I got was "I'm in Riverdale House in Shipley". Anyway this bloke was telling me that he was in Riverdale House in Shipley where I was stood and he wouldn't let it drop no matter how much I told him I was looking at an empty office.
I drove back home and called them again and asked if I could speak to Adam Sinclair (cashback manager) and was told that he was out of the office for the next 10-15 days, to which I replied 'again?'. I then asked to speak to Meredith Walker (customer services manager) he went away for a minute and came back saying she was busy could I call back in 30 minutes, at which point I explained that seeing as how their lines close in 15 minutes, I'll not bother.
After a bit of searching on the internet I have found that they have registered another address

This address is even closer to me so I called in after work today.
They were a little reluctant to talk to me but eventually a Mr. Hussain came to chat and after he took my name and postcode and an earbashing he went away for 5 minutes and came back with a cheque saying 'There, that only took 5 minutes' to which I replied 'Bo**ocks, THAT has taken me 6 months, it's taken YOU 5 minutes'
When I told him I'll put his name and the 'new' address on the forum he implied that now I was sorted, there was no need for me to do that.
I hope you all get your money back and I'll let you know how I get on with the rest of my cashback.

Unfortunately I discovered this website to late, and so haven't followed the correct procedure as has been advised by several people earlier on in this thread.
Here's what has happened to me so far:
1st Cashback - Paid by TMO
2nd Cashback - Paid by TMO
3rd Cashback - Received by TMO in August but not paid
4th Cashback - Not acknowledged that they have received it in October
5th Cashback - Received by TMO but not paid in November.
I'm actually unsure, which of the last two cashbacks TMO say that they have revived.
Anyway instead of sending everything by special delivery and photocopying/photographing it all I sent everything by recorded signed for.
I suppose this doesn't matter much apart from with my 4th and 5th cashbacks. For both of these I have a 'Royal Mail Signed For' receipt, but when I go and look for a signature on the royal mail website it says it is unavailable.
I'm owed in the region of £200 and really not sure what to do next, and whether it is worthwhile taking it any further then emails. I've sent them various emails telling them about my status, but - you guessed it - no replies.
Any help would be appreciated. Thanks.0 -
I too have been having a nightmare..........I have been accepted by The Mobile Outlet as being owed money back,,,,,but yet have to recieve cashback for 1 or 2
So I have filed for small claims, if i win the case can i there for cancel my contract?

Whatever the outcome of your court case, you cannot cancel your airtime contract.
This is a separate contract between you and your network.0 -
Just to clarify - my 120 days were up last wed - so do I send the bill I was sent last (a few weeks ago) or the next bill I recieve?0

Quick update on my "story" , still after cashback claim numero 2, 3 has already been accepted and 4 is being sent off today special delivery to beat the xmas rush. I have filed a MCOL claim , and was issued by MCOL on the 7/12/07 , says they have 14 days to reply, as yet according to the website, no response !!! I have given up ringing them and getting the same old bullsh*t, so just doing it this way. When the 28 days is up on the 3rd claim, LBA will be issued, before another MCOL is raised no doubt !!

The 14 days that the court has given for the defendant (TMO) to pay have been completed yesterday.
My sister today has requested Judgment by default online.
Now my question is: could TheMobileOutlet have filed a defence yesterday at the last minute ?
How can my sister determine now if they have filed a defence or not? The only way I can imagine is either by phoning the court or waiting for the court's written confirmation? Am I right here?
From anyone's past experiences with the mobile outlet, do they normally file a defence? if yes, when do they normally do that? at the beginning or end of the 14 day period?0 -
You can ask for judgement on line via MCOL.
If there has been no defence filed, then the judgement will go through. If there has been a response to the summons, then you will be informed of this when you ask for judgement, and the court will send you the defence together with instructions on what to do next.
A defendant can submit a defence at any time prior to the judgement being requested (even if the 14 days since service are up), so it is in your interest to ask for judgement by default as soon as you are able to.0
