I'd be interested to hear from people who have actually taken it through to the court.
Cheers,
Don
I had 2 separate court cases against our 'friends' TMO this yeardon9999 wrote:Have TMO turned up or not?
They didn't turn up in either casedon9999 wrote:Have they turned up in person, or by a representative?don9999 wrote:Did they employ a lawyer?don9999 wrote:Did they put forward a case?
In one case I was awarded the full years cashback, in the other I was awarded all outstanding cashback and TMO were ordered to pay the remaining claims within the 28 days0 -
Just an update for those interested in my case against TMO (documented in various posts on this thread....):
Great post, very useful. They underpaid one of the sums awarded to me by £20, I've not yet got round to submitting the paperwork to get the warrant issued, must do that asap.0 -
I am trying to call them this morning but they seem to have switched off their customer service. The automated service (the female voice) proposes the three options but then, as you press "2" for customer service, it ends in an engaged tone. Has anyone tried to contact them since this morning.
Their new number is 01274718568. The guy at the other end of the phone was not pleased that I got that number. He told me that the phones will soon be transfered to India (are they outsourcing?).
Anyway, I think I will try the small claims court:rolleyes: Links are a man's best friends.com0 -

I think you could be right as they've now changed their number to 0871 427 3500 and when the phone rings it sounds like you're ringing Timbuktoo from the tone and weakness of signal !!! F-ing cowboys ....0 -

Watch video of mobile cashback deals reports17 October 2007
Cashback is the secret weapon of the mobile phone industry. Offers of up to £1,000 cashback are used to lure customers into signing mobile phone contracts. But you know what they say about deals that sound too good to be true...
Viewers have complained that they haven't received their cash and have been left tied into high-cost contracts with the networks.
In August this year, retailer Mobile Connections/Dial a Mobile went out of business owing 60,000 customers an estimated £12m in cashback deals.
We've had complaints about other companies, too. Wayne Shepherd took out a 12-month mobile phone contract with Chatterbox.com in October 2006. The offer included cashback of £321 in three instalments. His contract has now expired, but he still hasn't received a single penny.
So why is the cash not coming back? Kevin Patel, CEO of Chatterbox.com, blames the networks. He claims 3 Mobile in particular has worked on the basis that only 40 per cent of customers bother to claim their cashback. He says the actual figure is more like 80 per cent - and that he can't afford to pay all those customers.
In August this year, the major networks agreed to a voluntary code of practice set out by Ofcom. They promised to protect consumers from the mis-selling of mobile phone contracts. Ofcom plans a review this week and will impose mandatory regulations if it's found the networks aren't protecting their customers.
3 says: "3 has never encouraged dealers to follow a 40 per cent redemption model. Cashback is an arrangement between retailers and the customers - the networks are not liable for any arrangements between the retailer and the customer. However, 3 is concerned by the cashback-related complaints it continues to receive and has an established process through which all cashback complaints are dealt with."
Orange says: "Orange does have a responsibility to ensure that its customers are supported appropriately. Any Orange customer who is unhappy with the way they have been treated by Dial a Mobile, and feels they have been signed up to a contract that does not suit their needs, should call Orange to change their package." The cheapest Orange monthly package is £20 per month.

Don't quite know what you are saying.
Have you won your case - and the Court have issued a judgement against them?
Or do you mean your claim is being issued? (Which doesn't mean your case is approved, just that you filled the form out correctly)0 -
I mean my claim is being issued.0

Tyler Durden, thanks for you info.
I now have an idea of what to expect - that they probably won't turn up.
TMO actually sent me a cheque, received several days after they submitted their defence to my claim, but back-dated to a date a month earlier, 2 days before I submitted my claim.
I'm banking the cheque, and when I know it's cleared, I'm going to proceed with my court case where I am claiming the full cashback of £360 + court fees (less the £96 cheque payment).
Even though they paid the first installment, it was only after 2 months, and a lot of chasing including the court claim. They have then try to decieve the court and myself by claiming to have paid in time - all they did was back-date the cheque.
I'm not prepared to go through this process for each installment, and therefore will proceed with my claim for FULL payment.
Cheers,

Are you planning on making a claim for upfront payment of the rest of your cashback (less the £96 you've recieved already)?0 -
Hi I have just had to make an online claim against Mobile Outlet as they have told me that I sent the wrong bills for my 3rd cashback claim. I definitely did not and wrote to them breaking it all down and sending copies of all the bills that I have kept. I have not heard anything so I have emailed them and wrote a LBA - still nothing. So today I registered a claim online but I think I have made a mistake. Firstly on my claim, I only wrote a short description of what has happened and did not give dates or too much in depth detail as I thought this would be asked further on the claim, I also made a mistake on one sentence:
They have NOT responded to any of my letters and I have copies of all my bills. I missed out the word NOT.
I only noticed when I looked at the pdf claim. Will this make any difference and will my lack of information effect the claim? Never done this before, so feeling a bit stupid, now looking back at the claim that I cannot amend.
Many thanks0
