    Like many people on the forum, I have raised court claims against TMO on several occasions. Following my latest court claim, I am fed up with their defence and am seriously considering following on through to the court.

    I'd be interested to hear from people who have actually taken it through to the court.
    • Have TMO turned up or not?
    • Have they turned up in person, or by a representative?
    • Did they employ a lawyer?
    • Did they put forward a case?
    In my latest claim, they were due to pay me cashback on 8th October. As with EVERY single cashback, they failed to pay on time. Exactly on day 28, they sent me an E-mail saying they had received my application (they had actually received it 28 days earlier, for which I have proof) and that they would pay within another 28 days.

    I wrote back immediately, granting them just 14 days before I would start a court claim ie. 22 October. Again they failed to reply, despite a number of further warnings.

    I raised a court claim on 26th October, and the claim document sent out by the court stated that TMP had until 14th November to reply.

    On the 12th November they filed their defence stating:
    "sent to claimant on 11th Oct 07. if it has not been received needs to let us know so we can issue a stop on the cheque with our bank."

    'Conveniently' a few days later a cheque was received, dated 11th October.

    Clearly they had only just sent the cheque and just back dated it to the 11th October. I am 100% confident that they will have no proof of delivery in October. They failed to respond to any of my chasing E-mails at the time, before I raised my court claim.

    I am just fed up with them.
    I am fed up of chasing them through the courts for every payment.
    'We' have to obey every item of their T&Cs (which I have always done), yet they think they are able to flout the payment dates (also included in their T&Cs) using a variety of excuses.

    I am really considering proceeding with my court case, in which I am claiming the FULL cost of the contract £360 plus court fees. If we miss a deadline then we forfeit ALL cashback payments. Hence I feel that if THEY miss a deadline then THEY should also forfeit ALL cashback payments. Otherwise they are clearly unfair T&Cs.

    Before I proceed, I'd like to hear what has happened when other people have rejected TMO's defence and taken them to court. I just want to be prepared.

  • sorry i know this reply isn't going to help you, but i also started a tmo deal earlier this year. i experienced the same problems as you on the first cashback claim. slow responses to emails, ages to acknowledge they recieved my claim etc.

    i eventually got one cheque from them for the first 4 months i think. at that point i decided i just could not be bothered to deal with them anymore, so i just paid the contract to three, and after 6 months downgraded to a lower tariff. finally now i can cancel my contract as its been almost 12 months.

    from now on i will either be using pay and go, or getting a contract direct from a mobile network. cash back companies are just not worth the hassle. the whole system of profit from those who dont claim is totally ludicrous!

    sometimes its best to accept the decision to sign to a deal was a mistake and lose a little financially, for the sake of never having to think about it again. personally i was relieved after i made the decision not to bother trying to claim again.

    Like many people on this forum, I have been using these cashback for many years now with a variety of companies. I think I'm on my 8th or 9th deal between my wife and I. Some companies have so far proved faultless - such as buymobilephones, who have always quickly acknowledged receipt of claims and paid them promptly. Similar with E2save.

    TMO 'used' to be acceptable, paying either promptly, or at least within a few days of the agreed date. However, recently they appear to be only paying after a court action is raised.

    I'm happy to chase up with appropriate court action.

    I'd just like to hear of experiences from others..

    You should proceed - unless you do, you will be "down" your court fees, and will lose this opportunity to get everything from them now without having to go through this stress for every claim. Also, with the latest liquidations in the cashback game, you never know how long firms like this are going to be around.

    Keep a diary of the dates involved, (you can safely bank their cheque - though keep a copy of it, and the envelope it came in), the courts are used to defendants sending backdated cheques to try and get out of a legitimate claim.

    After filing late August for a small claims court, finally been allocated a date mid January. This is ridiculous.

    Would still like to hear from anyone who has actually 'faced' them in the court. Just want to be prepared as to what to expect.

    First time poster on here, been reading about TMO on here for a while, but its got to the point with them that I need to get it off my chest how shoddy a company this place really is.

    Now, I am currently in the process of getting my cashback for the magical 2nd time, having already sent the 3rd one off, but the problem is the 2nd one at the moment !!! I never had a problem with the first one, they received all my docs on time sent the email confirming this had been accepted and got my BACS payment without needing to chase them, however if only things had gone that smooth on the 2nd. Again I sent all my docs back with good time, and on the 5th Sept got a mail saying that it had been accepted, however to date and after about 10 separate phone calls and them hanging up on me (another trick they have) I have still got nowt from them, other than an angry face everytime I hear the word mobile outlet mentioned. They first of all gave me the line that their BACS system was down and it will take up to 60 days for payment to be made to me, that would have been the 5th of November. I have chased them repeatedly, they have given me the line that it will be paid, it of course hasn't. Last week I was told they have now sent a cheque, which I have still not got, today I rang and they say that as i still have not got the cheque they will cancel it and send a BACS payment that will take up to 10 days meaning I have now got to wait another 10 days before I can chase them as I know it wont come through. Its like a merry go round, and am back to waiting for a BACS payment ! The 3rd part of cashback was also delevered a little later than usual but was delvered to the address within 16 days of issue of the 9th bill not 21, Bill date was 10th October delivered to them on 26th October, due to the postal strikes took more time than usual, however I have still not received any email from them saying that it has been accepted yet !! Has anyone got any advice for me as this is beginning to become a bit of a joke now, is it worth looking into small claims court yet ?
