  • Does anyone have terms and conditions for the mobile outlet from about Oct 06.
    I have received first 3 cashbacks- then on fourth they say I did not send whole bill- however I did not send whole bill before and they paid up!
    Unfortunately I did not keep copy of T&C as it was on back of invoice I had to send to them with first cashback.
    The T&C are on their web site but I think they have changed.
    So if I can get copy of original T&C it would help
    I am arguing with them over it anyway!!!

    No-one has attempted to help you yet!

    It is only 41 minutes since you first asked for help. Be patient. It is better to be polite rather than get so "aggressive".

    In the meantime if you glance through the thread you will see how helpful everyone is when questions/requests for help are asked for, and the polite way they are generally requested. (You might also find a source for your missing conditions)
  • Cheers Quentin. I have read the previous 6 pages of posts, but am at work so cannot sit for hours trawling for some guidelines, will have to read up on it later. It sounds like unless you threaten them with some sort of legal action that you get put off and put off. Has anyone else had to wait as long as I have to hear whether their cashback claim was accepted or not, bearing in mind that it was delivered to them on the 26th October ?

    am new to this- thought the message from Quentin was for me- see how it works now I agree patience is a virtue, but not with Mobile outlet- patience has run out here!!!!

    If you look at the page before this one, post #1192 it seems that that person has had the same shoddy excuse from them about the bill not having the itemised part on it !

    Just looking up on how to draft up a letter to fax and post to them for my 2nd cashback to try and get some "prompt" action, so many helpful posts though !!!

    Another fact to note is that so far in my past 3 successful claims for this contract, I've only included the top page of the bill as advised and never had any issues.

    I've sent them an email regarding this, lets see what happes.. Tyler Durden UK, I might need you help on how to raise a small courts claim..:)

  • Just an update for those interested in my case against TMO (documented in various posts on this thread....):

    Last Friday I finally got my cheque from Bradford County Court Bailiff's office for the last £55 that I was perusing TMO for. So effectively, it's game over, with me as the winner!

    I originally applied for a warrant back on 13/08/07, and this is when I incurred the £55 warrant fee. Although it would appear that this had the desired effect, in that less than two weeks after the warrant was issued, TMO sent me a cheque for my warrant amount (roughly £185 cash back and £30 MoneyClaimOnline (MCOL) claim fee), but minus £55 for the warrant.

    (For those who are doubtful about enforcing a judgement in their favour with a warrant (and spending another £55), I have doubts whether I wouldn't received a cheque for my claim as promptly if I hadn't applied for a warrant. However, I did check with the MCOL helpdesk about this, and they advised me that to wait 1 week for payment of the judgement was reasonable, and then apply for a warrant - advice which I followed).

    Peculiarly, TMO's cheque was predated to the very date before I applied for the warrant, despite me receiving the cheque some two weeks after this date, which immediately made me think they were trying to get out of paying me the £55. Although pursuing this £55 was a long and drawn out process (almost 3 months in length), delays caused I believe partly because TMO had changed premises, partly because a letter from myself to the bailiff's office went missing in the post for 2 weeks, and partly because I knew it was only £55 they owed me (and therefore did not chase this up as much as I perhaps could've), I have now received (and banked) the cheque.

    I would just like to say, although this is 'game over' for me, I hope others out there who have had their cash back claims rejected by TMO, perhaps on a technicality, or perhaps by being misled by TMO's T&Cs like myself, stand up and pursue TMO for the money that they're owed. If you have done nothing wrong and have acted in good faith, there's every chance you would win, and get your money back. Claiming is easy and inexpensive, there's a wealth of advice on this thread if you are prepared to read it, and remember you get your costs back if you win, although you may have to wait for it, like I did. :)
