Why not re-apply for a blue badge it’s all changed now,
If you are not on DLA/PIP high rate mobility you are sent for a Atos medical. This is to weed out ignorant have-a-go knob-ends and only issue blue badges to genuine disabled people who have satisfied the medical test.
I've applied and been turned down three times now, every time the medics have confirmed the progressive worsening of my condition - and more or less been told to forget it until the surgery fails. Strong supporting evidence has been ruled out each time. Never been asked to a medical.
I'm not on any benefits yet - Still just managing to hold down a job, although with massive reasonable adjustments and support from my employer but even they are beginning to sound exasperated by my position. I'm pretty much reduced to desk work, providing backup for my colleagues instead of specialist field/lab work which was my line before.
And the very first adjustment they offered me was use of disabled spaces on all our sites - Which made my occasional encounters with our PPC goons a bit of a laugh!
And this is still the salient point - Its the Equality Act that trumps everything else on private property, even the Blue Badge regs - So there, I and others in the same boat can claim the appropriate adjustments, regardless of the failings of the system and the ignorance of people who think it means something there.0 -
I did that on Tuesday....nothing happened.
To clarify though, I DO have a wheelchair/crutches and I DO have a disability (well several of them) but no blue badge...not through refusal or not meeting criteria, just not got round to getting one due as things have been a bit eek with youngest and have had no time to apply and before that, complete denial I had a problem and that I would magically get better!
However, I only ever use a disabled space if my joints are really really bad and movement, even to my wheelchair from the car seat is difficult, so requiring the extra space to fit the chair by the door. The rest of the time I use a normal space and hobble to the back of the car to the wheelchair.
Well SingleSue, how can you live with yourself being able to get a perfectly good blue badge, not do so and not use disabled spaces!!! this simply will no do when there are so many people out there could buy it off you and make perfectly good use of it :whistle:
It's no use being brave and taking one of those spots that the able bodied are entitled to. There might be someone with a great set of legs, be perfectly healthily wanting that spot the disabled person has taken, how can you sleep at night?

.....took my brother in law to doctors today. Woman in range rover with two kids beat me to the last disabled space. Brother in law has badge, can hardly walk and unsteady on feet. Asked her if I could please have the space very politely and she told me there was nowhere else she could park. I informed her it was a disabled space and the person with me needed it. She then claimed she was disabled, grabbed a blue badge clock ( not the badge itself) from her car and chucked it on the dashboard and she and her kids ran into the doctors.
I am truly shocked that anyone can be that selfish. What a terrible example to set for her kids!!
You were perfectly within your rights to ask someone not displaying a badge to vacate the space. I would [immediately] have (1) photographed the vehicle and [later] sent the evidence of clock & no badge displayed to the issuing authority asking them to check the known details for fraud against the badge register, this would 'flag' that registered owner & vehicle as a potential or actual BB fraud candidate with luck that misuse would lead to the a maximum fine on conviction of £1,000.

The GP has a duty of care to his patients. (2) I would have gone in to the practice and made a formal request to the reception desk for an immediate vacation of the disabled space. The GP pays for the space as part of the lease for his practice. The GP under the '95 DDA as well as marking out disabled parking spaces, they have taken reasonable steps to ensure that they are available to disabled people. Let the GP and / or / his practice manager decide which of his two patients get to park in the privileged and expensive bay they [the GP] pay for:
- the legitimate BB carrying individual
- the non legitimate BB carrying individual
Any reasonable person in authority would decide on the badge carrying holder.
Any legitimate BB holder not displaying the badge, even if they have one, should be turned away. Any legitimate BB holder not displaying the badge, even if they have one, should have a first strike warning issued, a suspension awarded or revocation issued in the case of the three strike rule for bringing the Blue Badge scheme into disrepute. A BB holder is issued with a Blue Book and knows [or should know] the rules on displaying the badge.
The badge counts........not displaying a badge means you have no right in the blue badge bay. The usual reason why people display a badge obscured, or the clock only part, is fraud, fraud is dirty filthy cruel stealing from the disabled and then causing pain and distress - no different to a mugger battering an old lady then stealing her transport as well as her money. This one occurrence would only be one of dozens of fraud offences committed each and every month by that person, photograph the evidence for the GP the car park owner and the issuing authority, and make sure they get that evidence.
NOTE01 : Many LA's are willing to 're-assess' but There is no formal appeal procedure against a local authority decision to refuse an application for a badge. Formal appeals procedure only exists in relation to a local authority's refusal to issue a badge where the person already holds a badge but has been found to be misusing it.
NOTE02 : The '04 TA gives enforcement officers the power to inspect blue badges. It is an offence to fail to show a badge and on conviction is punishable by a fine not exceeding level 3 [£1,000].
NOTE03 : Measures for plain clothes inspectors to be able to [snatch] retain a badge that has been produced to them and which is cancelled, due for return, being misused or fake are still ongoing.
NOTE04 : Baywatch has the support only - of the DfT. Asda stated in early 2008 that it would issue £60 fines to motorists parking in disabled or parental spaces to which they are not entitled. The current 'Disabled Link Up’ initiative between Asda, Safeway, Sainsbury’s and Tesco, to ensure a commitment to improve car parking facilities for their disabled customers is ongoing.
NOTE05 : Part III of the Disability Discrimination Act 1995 requires service providers to take reasonable steps to ensure that disabled people do not find it impossible, or unreasonably difficult, to enjoy the service on the same basis as non-disabled people. This will have implications for car park operators, who may have to demonstrate that, as well as marking out disabled parking spaces, they have taken reasonable steps to ensure that they are available to disabled people.

ATOS don't do the Blue Badge medicals.I am not extremely stupid or extremely naive, I also don't think Atos is fair but the law is the law

It's a Atos medical for blue badges, not a ATOS assessment for ESA or PIP.ATOS don't do the Blue Badge medicals.
Not everyone is required to do a medical, even those who do not have an award for PIP or HRM DLA.
But certainly, in any case, it is not an ATOS assessment.
Check with your local authority about the new changes regarding medicals for blue badges yours might be different, my local authority are using the Atos medical facilities in our area for blue badge medicals.0 -
Blue Badges, most, as in 90%+ are issued as a result of a DLA award. That DLA / PIP award is ATOS based - therefore ATOS already do control [eligible without further assessment] the majority of blue badge awards.
As for ATOS actually carrying out a blue badge 'subject to further assessment' medical, I think this is a good idea. The HR DLA / PIP will take care of most deserving blue badge needs, the [subject to further] need to demonstrate :
- a permanent and substantial disability which means, unable to walk or virtually unable to walk
- a temporary, but substantial disability, unable to walk or virtually unable to walk for 3 months but less than three years
- a severe disability in both arms, making it very difficult or impossible to operate parking meters, and drive regularly
This is a quick, zero tolerance, and cost effective way to get rid of the fiddlers.
NOTE01 : My comment applies only to 'subject to further assessment' medicals' for a Blue Badge approval.
NOTE02 : 55% male - 67% over 65 - 2% less than 2 years old - 94% white British - 5% working - 63% retired - 46% in SED&E - only 25% had a household income of over £15,000 - length of time of Blue Badge Issue 4 to 6 years.Disclaimer : Everything I write on this forum is my opinion.
