I submited my claim on the 23rd June 09, on the basis of hardship. I received a letter offering me £980.00 today, I cant beleave that its taken just under 5 weeks. also it will not affect my current claim. Im extreamly happy, and can pay off outstanding esential debts.:) Thank you Martin xx, also thanks HSBC0 -

i downloaded the template to make a claim going with the FINANCIAL hardship way.sent form to head office by recorded delivery 16th june 2009. 4days later received financial statement.filled it in sent recorded again. 7days later received a goodwill offer of £836.00.sent the acceptance form off by recorded once again.got letter to say the amount will be in my account within 21days max.

The story: Sent in letter to claim, got back letter asking to prove financial hardship, filled in inc and exp form, replied with offer of paying off the charges to debt company. All done

If it is the latter then the rest is still on the table and if it is the former then that is against the FSA Waiver on bank charges.

Could you possibly let me know how Natwest doesn't judge the fact that i am about to be made 'Bankrupt' because of IVA arrears as being in hardship???
Would i have to be sleeping rough for them to judge it as being in hardship??
If you could find out for me i'd be very grateful as your 'hardship' dept don't seem to understand the position i am in. thanks.0 -

Did you not read in his signature "I have not worked for NatWest Bank since February 2009" ? Even if he did, I doubt he'd be inclined to answer your question, when you ask it in such a rude manner.
Anyway -
Is it just me being daft or do Lloyds TSB seem to be the only bank that are refusing to pay out?
Ive been trying to claim back £1560 from them for 9 months and they are refusing to budge, even though they have accepted that Im in hardship :mad:0 -

The bank only knows what you tell you them. The IVA is supposed to reduce hardship since it is a negotiation with your creditors to reduce Financial Hardship. If any of the debts are credit cards then you can reclaim them straight away.

No because it wouldn't necessarily be a definition of hardship because you wouldn't have arrears for a house you wouldn't be living in.

As someone else has said, please read my signature. I don't work for the bank and have not done so as a member of staff since February when I was dismissed. Since then, apart from getting a new job, I have educated myself not only on how financial hardship works but what constitutes financial hardship. I do understand your frustration that the bank made an offer and you were unhappy with this and that the FOS upheld that.
I have specifically given advice on that element of the case and you need to read the reasoning behind the offer. The difficulty is advising on what to do going forward since going bankrupt will mean that even if the bank charges test case ends, you would be ineligible for the charges you have reclaimed.0 -
Had great success with the ABBEY on reclaiming our bank charges. Total claimed was £1780 and we got £1650 refunded!!
We did prove we were in financial hardship and provided an income and expenditure form for the bank. The whole process took around 2 months.
Glad I persevered with this and thanks to this website for providing the initial letter template.

I had my claim in two years ago with the FOS, it was put on hold. Claimed again via FOS for financial hardship, filled in the forms from bank, then FOS said it wasn't financial hardship! Emailed them back to ask why - got no response, then today got a letter in full and final settlement - in excess of what I'd applied for! Am happy, just dying to get my hands on the cheque so I can pay my mortgage arrears in full!0 -

The story:
Missed a payment in November 2007 on a "Home owner loan" from then till I made that payment in July 2009 Halifax added £495 in charges to my loan account.
Got full statements (they never send these out on Loans) added up the charges and wrote to them on 18/07 asking for refund on £495.
After "holding letter" from them within two weeks, today recievd a letter saying that "I can confirm that the chages have been applied correctly, in line with the T&Cs. In light ofthe above, I am unable to uphold your complaint; however I am keen to resolve matters to your satisfaction. Therefore, as a gesture of goodwill I have arranged to refund the charges to your loan account."0 -
Excellent! Unfortunately our refund has been paid into our current bank account which we were in an unauthorised overdraft with. And needless to say we got into an unauthorised overdraft because of the bank charges!!
Would have been nice to have a cheque to pay our mortgage arrears.....0
