I'd like to see what Aldi's response is first. It's either a 'Yes, we will refund any such cases', or 'No, we won't'. I don't think they should be given any room to wriggle on this one. They are the principal and should be the first in line to shoulder responsibility.
One might, for a nano-second, feel that PE have not been given the full planning permission picture and have gone ahead with 'normal' Aldi signage, and opened their tills.
Depending on the Aldi response, it should be either contact the store direct and await your cheque in the post, or serve small claims court papers on both Aldi and PE as first and second defendants.
But, I suspect that this is just a tiny tip of a very large iceberg which could develop into a situation not dissimilar to the PPI mis-selling fiasco, with some hefty bills finding their way to one or both outfits here.Please note, we are not a legal advice forum. In the case of a retail store or retail park and an offer of free parking I don't believe that there is ever a contract for parking. With the offer of free parking the occupier of the land is giving permission for the motorist to park in order to lure them in as a customer just as they give the shopper on foot permission to enter their store or use the toilets. There is no contract to pee. The occupier can put conditions on that licence e.g. define a maximum stay but if the motorist breaches that licence then they become a trespasser. Then it is open to the occupier to seek damages. There cannot be a parking charge of £x as liquidated damages are only agreed between the parties of a contract & in the case of trespass there is no contract.0

Another day another victimTruly appalled! My Dad was holidaying in North Wales and shopped in your Bangor store, he has returned from his trip to a letter from your parking company saying he has to pay £70 as he didn't put his registration number in a machine. He didn't see any signs about this, and there was nothing in store, and no reminder from staff at checkout. There were however lots of signs stating he was parking in 'Aldi Car Park' which is very misleading if this is not true.
I shop every week in your Huddersfield stores, and have been raving to my friends how they should shop with you. Now this has happened I will hesitate to recommend you as I would hate for other people to go through this.
I have told him to NOT pay this unjust 'fine' and contact your customer services, in the meantime I hope that lots of people see this post and think twice about visiting your stores.

We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
