My son went to Liverpool Airport late at night to collect his girlfriend, he stopped in a line of cars on the approach road to the car parks. Having looked at the overhead signs to see which carpark he needed he moved off. VCS have sent him a parking charge notice for breaching carpark rules.:rotfl:Just trying to work out what the landowners losses are.

    It sounds like you already have the right attitude already to such a joke invoice.

    I don't believe that you could be said to have "parked" in this situation, and, if the land is subject to byelaws (which it probably is), then RK liability would not apply regardless.

    Now that is a classic one to appeal and take to POPLA. :D

    My son has now shown me the PCN, first two pictures 5 seconds between them show the front of the car with its headlights on, a third picture 20 seconds later shows a row of three cars with their headlights on, all the cars are well spaced and appear to be driving down the road. It is impossible to say which car he is in as it is just a very poor picture of a row of headlights,however, he thinks he was third in the row.

    So it appears to me that he was possibly stationary for about 5 seconds is this a record?

    My son has asked for my thoughts on whether to appeal and get a popla code when they reject or just ignore on the grounds that the PCN is ridiculous. I'm not sure what to advise as appeal and request of a popla code should bring a quicker end to this joke or just collect the letters.

    Definitely challenge it and I would actually make the first challenge jokey! :D

    Read post #40 in the 'POPLA decisions' thread (top of this forum) for a classic example of a jokey first appeal to the scammers followed by a strong POPLA appeal which won. Of course...because we do know how to win at POPLA.

    It's just that this PCN is so daft it should be addressed with the contempt and scorn that it deserves at this stage - why not?! But always write the first challenge in the third person 'I am the registered keeper of the above car and on that day the driver did this...' NOT admitting or implying who was driving at all which protects your position at this stage.

    It's the POPLA stage that will be the important wording.

    Now four weeks since soft appeal was sent in and not a word, not even an acknowledgement which I think I'm right in saying should have come within 14 days according to the BPA cop.

    Yep, should have been acknowledged within 14 days and an answer within 35 days. Patience!

    Count 35 days from the date of your challenge to them. They accept or reject within that timeframe
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Wouldn't them not acknowledging an appeal within 14 days mean they can not use POPLA as they have broken BPA cop?
