VCS and APCOA have been criticised by us lot so much by complaints to the BPA (mainly about late NTKs) that I think they also have a 'non-POFA' version. Certainly APCOA and CEL do, not 100% sure about VCS.
But remember that lack of POFA 2012 doesn't mean lack of POPLA. Easier to win in fact = no keeper liability at all!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Seems one of the ploys they use is to wait for you to write to them telling them they are out of time so appeal deemed as accepted. They then send you an appeal rejection and POLPA code as if they have done nothing wrong. POPLA do have a record of not allowing appeals based solely on the PPC having failed to respond within set time-scales thereby making the BPA 35 day guide line irrelevant. So this could be a trap set by VCS though maybe I'm mistaking incompetence for cunning .0 -

Which following advice from good people like yourself my son won't be doing or writing to them again, unless they send a back dated rejection.0 -

Spoke to soon, appeal rejection and POPLA code received today dated 150+ days since appeal sent and ignored by VCS, 35 days since copy of appeal received letter from VCS.
As the driver has not been named despite them making several requests they are claiming my son as registered keeper is liable under POFA 2012.
So let me see there reply claims:-
1) The approach road to Liverpool airport is relevant land for POFA.
2) VCS class being stationary as parking.
3) By passing the signs the driver agreed to be contractually bound by the terms and conditions.
Appeal to POPLA being worked on and will include
1) Prove it is relevant land for POFA and not covered by overriding by-laws.
2) As VCS photo shows a row of cars and as VCS claim stopping on this road can cause an obstruction prove that the driver had any other option other than to stop.
3) Prove signs can be read while driving passed at speed limit.
Oh and not forgetting
4) Prove £100.00 is a GPEOL.
Anything I've missed?0 -
And don't forget the complaint to BPA and DVLA for breach of the BPA Code of Practice. Every single breach should be reported, just to make them aware of the wholesale, persistent, cynical way these companies just don't give a s**t about anything except scamming the public.0

That one would be a basic Airport POPLA appeal wording to adapt (not the decision, the POPLA appeal shown below it).

I was there earlier there were around 6 cars waiting to turn right into Dunlop road. Leaving the airport all were stationary, waiting for the inbound road to clear.
There is no way you could stop and read the sign as you enter the road as you would block the junction. The only ones you could safely read are the ones on the lampposts and the fences.
Speke hall avenue is definitely not a car park or even an approach to a car park!0
