Yes but the not replying by day 35 just strengthens the breaches.
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Wouldn't them not acknowledging an appeal within 14 days mean they can not use POPLA as they have broken BPA cop?
They can, and hopefully will, use POPLA. They have breached the code in the way you have said, and that (along with other points) will win, and cost them £27.

Doesn't stop the motorist using POPLA.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Forgive my ignorance here, c-m, but I thought you had to have a POPLA reference number to kick things off with POPLA appeal and that came from PPC.

Yep you are right, I was trying to answer this:

How did you submit your appeal?
    - By email? Did you get an acknowledgement it was received (auto-reply)?
    - By web form? There's normally a reference number generated.
    - By good old letter in the mail? Did you get a receipt of posting or confirmation of delivery?

There's a chance you'll start getting more junk mail in the form of threats from VCS or their fake debt collectors, at which point they'll deny they ever received your appeal (amazing how much post goes missing on the way to PPCs). Some form of proof you submitted the appeal may be useful.

It was sent by normal post, so I expect they will not have received it .

Still as popla accept the word and a copy of any letters as proof that their members sent the appropriate letters, at the appropriate time, I'm sure they will accept the same from members of the public.:rotfl:

Now over 50 days since softappeal with a request for a popla code if rejected and no response at all from VCS. So either they will claim never to have received the appeal, they are still reading it or they have already given up hope of getting money out of my son.

So, 97 days after sending an appeal as the registered keeper but not naming the driver and asking for a popla code if rejected VCS have sent a LIABILITY NOTICE demand for £100.00.

One of the three possible reasons for issue is "'you were the registered keeper of the vehicle at the date of the contravention and you have not responded to the parking charge notice or you have not provided a full name or serviceable address for the driver".

So it's not clear whether they have ignored the appeal and request for a popla code if rejected or have not received it. The demand also refers to the Privately Operated Access Roads to which the demand relates being a car park and covered by Schedule 4 of the Protection of Freedoms Act 2012.

Question is:- Is it worth another stamp to tell them they are out of time as they did not reply within the time required enclosing a copy of the appeal letter or another option?
