Liverpool Airport VCS

morrisoscar wrote: »So, 97 days after sending an appeal as the registered keeper but not naming the driver and asking for a popla code if rejected VCS have sent a LIABILITY NOTICE demand for £100.00.
One of the three possible reasons for issue is "'you were the registered keeper of the vehicle at the date of the contravention and you have not responded to the parking charge notice or you have not provided a full name or serviceable address for the driver".
So it's not clear whether they have ignored the appeal and request for a popla code if rejected or have not received it. The demand also refers to the Privately Operated Access Roads to which the demand relates being a car park and covered by Schedule 4 of the Protection of Freedoms Act 2012.
Question is:- Is it worth another stamp to tell them they are out of time as they did not reply within the time required enclosing a copy of the appeal letter or another option?
Anybody any thoughts on this please?0 -
You can either ignore them from now on, or inform them that
(a) the private roads at Liverpool Airport are not covered by POFA as they are covered by Byelaws, so POFA doesn't apply (may not be true, but that's for them to prove), and
(b) as they didn't reply to your appeal within the BPA Ltd COP stipulated period, your appeal has been assumed as accepted (include a copy just to be sure), otherwise they must issue you with a POPLA code.0 -

Was going to advise my son to go down the 35 days have passed since I sent my appeal which you have ignored, your out of time go away route, but have read on another thread that POPLA are rejecting this as a valid reason for the victim to reject a claim. So should he write back saying your out of time, you have ignored my appeal, however send me a POPLA code or dont write again?0 -

Yep, that's what I would do.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Received a letter acknowledging receipt of appeal today, states they will be in contact within 35 days. Only taken them four months from date of original appeal which they didn't acknowledge.0 -
Still waiting for a POPLA code, but I have just found this.

VCS will be feeling pleased that they have won a few this week against what appear to be weak appeals.0 -
That was a terrible POPLA appeal, not what would have been advised if it had been shown first on the forum. All they needed was no genuine pre-estimate of loss, unreadable signage and not relevant land so no keeper liability, as nigelbb rightly said there.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Linked post has been updated to say one point appeal was done to get a decision on whether or not VCS have the right to operate there (not relevant land). Hope VCS hurry up with their court claim, shame if they don't because people might think VCS are worried they could lose, have to stop issuing tickets and sell the van.
Liverpool Airport might instruct VCS not to go to court as they would risk losing £20k a year income from them.:mad:0 -

Yep but it wasn't worded well enough even for that. I reckon one could easily win a POPLA appeal on that basis alone - if a PCN actually was issued with POFA 2012 on it, which Airport PCNS are often NOT nowadays since we exposed the issue. But nothing was going to be won with that muddled version of an appeal!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That’s an interesting change, the PCN issued to my son’s car does. Have VCS changed their PCN's and NTK forms at this location? If they have I can feel an'' I'm not naming the driver go away'' letter coming on.0
