Are the credit card companies paying the whole amount if you take them to small claims, even though the OFT says £12 is fair? What are people's experiences of this?

This is really inspiring and just the bit of info i have been after i have a capital one account and have claimed for £1300. they came back with an offer saying that there charges were fair but we would recieve £382. i thought that this is much less than i expected (without sounding to greedy) but felt what they were saying about there £12.00 charges put me off a bit can i just ask how long did the whole process take? and would you advise me to go further?0 -

My OH's claim took roughly 3 months from start to finish including requesting the statements (which came in record time), and I can only say go for it!

wrote my first letter to reclaim charges from my credit card totalling £295.00, had a letter back off HSBC basically saying
" they are not prepared to make any refund of charges due to they disagree with the OFT findings and although they have reduced its charges for the future,these changes do not affect charges already applied".
what do I do now?

I think you you need to send your second letter threatning court action if that doesnt work take them to court!!0

Don't forget that even the £12 is "extravagantly" higher than their costs of automatically adminstrating a late payment. All that happens is that the charge (sorry, fee!) is added to your account. You don't even get a letter.
Use one claim to fund the others. Now that's charge reclaiming in true MSE style!
And by the time you get to claim number 8, you'll be more than a match for the CCC involved. I nearly (but not quite!) feel sorry for them.The acquisition of wealth is no longer the driving force in my life.0 -
Thanks, you have all inspired me to tell my friend to keep at it and take them to court if need be. Any money she can get back will help pay off some of her debts (which these banks/CCCs helped her to accrue in the first place!!!)
How on earth does 1 person manage to get 7 credit cards. It's CRAZY!!!!! :mad:0
