I am at the preliminary court stage with MINT for just 3 charges for £44.00. If someone only mugs you a little bit, then is it legal? No.
Even the current £12 is still "extravagantly" higher than the CCC's costs. !!!!!!, their computer just adds the charges to your account, they don't even send a letter!
The only difference is (as you are aware!) is that the CCC's will try to use the OFT ruling as justification. The OFT can only recommend - they do not make the law.
The Lloyds case does not set a legal precedent, and even if it did, it was about bank overdraft fees!
BTW, you don't have to refute anything they claim. Just tell them that their reply is unacceptable (they know why) and give them 14 days to do the honourable thing, or face a court claim, your court fees and the 8% "statutory" interest. Just don't hold your breath expecting a cheque for the full amount by return of post, though.The acquisition of wealth is no longer the driving force in my life.0 -
On the same basis as recovering Bank Charges - has anyone any experience of successfully recovering Default Charges applied when payment is received late on Credit Cards
I have three Credit Cards each with a different Bank and essentially I post off the payment on a monthly basis but good old royal mail do not always get my payment there in time and so I am charged an exorbitant £20 in 'Late Payment' - the balance in full is ALWAYS paid off but they levy the LPC as well as 'interest' on the next months bill thus, in my opinion, I am charged twice through no particular fault of my own.
On the three cards I suppose this has probably happened 10 times or so which is +£200 and I would like to know how or if it is possible to be successful in reclaiming what is described by the banks as 'default charges'
Any advice would be appreciated

I am in the process of reclaiming these ridiculous fees as well. At present I have submitted five claims to different cc providers. One has paid up in full another has turned me down (so far), another has given me a decent settlement and yet another has offered a derisory 'settlement' which I am going to refuse. I think it is worth pursuing even though my charges are not large. You just need to follow the process described in the reclaim your bank charges section (template letters etc) but, naturally, adapt the letters to your own needs.0

Yep, you can claim back charges from Credit Cards!
I'm currently at the court stage with Monument Credit Card.... 28days up and I've not heard a thing... I'm waiting to see if anyone will answer my post asking if I should press the 'judgement' button!!
Have you asked for statements for the last six years yet? If you don't already have them ask first... then ask for your money back... if they say no and they will... then send a letter before court action (LBA) give them 7 or 14 days to respond and then start court proceedings.. most people are using Moneyclaim online - it's easy to set up)

Looking for some advice - I'm trying to help a friend in serious debt. I sent a letter to her Nationwide credit card to reclaim £80 worth of charges (5 @ £12 and 1 @ £20). This is a section from their reply:
"..... After careful consideration I've agreed to pay the difference in the charges you've incurred and that which the OFT has deemed to be 'fair' in settlement for your claim. This amounts to £8........"
Just wondering if we should
A) send the letter before action letter (bearing in mind she cannot afford the £39 cost for Scottish small claims court as she has huge debts to 7 credit cards and has no money).Write to them suggesting a settlement if they pay say 50% of the charges (ie £40)
C) Accept the £8

If she is in that serious debt, even £80 would make a difference. Could you as her friend not lend her the £39 to file a claim? It will go into the claim sum so is reclaimable, plus any statutory interest incurred.Reclaimed thanks to this site:

Problem is, she's claiming charges back from 8 banks/credit cards.... so if they all go the same way, I can't afford to pay £39 x 8. I'm pretty skint myself.
This is one of the smaller claims. I'd rather pay the money to take the larger claims to court... some of them are for a few hundred.
Are the credit card companies paying the whole amount if you take them to small claims, even though the OFT says £12 is fair? What are people's experiences of this?0
