Good luck Jo. Remember that the £12 figure is not legally 'fair'. The bank may well have u believe that it is as they have tried with me and many 1000's of others. No such figure has been decided yet. The OFT pushed the Credit Cards to lower Late Fees down as they were too high. As these fees are automated they would probably be at the lower end of the estimates of the real costs incurred by the banks of between £1 and £4.50. Food for thought? Read through the guides on here and arm yourself with all the facts and templates for your letters. ;)
Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....

Yes. The only thing is that the CCC will almost certainly try to also use the OFT ruling and reduction to £12 as justification that the charges are fair and reasonable.

Aren't there any posts involving CCC's in the Success Stories thread? I hope so - I'm taking on MINT!

    Hi Guys,

Love the site! and have been putting off reclaiming since before Xmas and have decided to take action! Have a few questions and a little scared to be honest.

    Q's:
    1) The template letter can this also be used for claiming charges on Credit Cards?

    2) Have heard the story about the Bank winning the latest case, should we be worried?

Look forward to getting some help!

    Many Thanks

MBNA have offered my friend a full & final settlement, (which she isn't accepting as it's only £80, when the claim was for a few hundred). Anyway, they're written that they will automatically credit it to her account. Can they do this? She'd rather get a cheque so SHE can decide which of her debts the money goes towards and not MBNA. They will be way down the list behind the mortgage, electricity etc....

Should she write to them and say she will accept the sum offered only as part settlement and only if they send her a cheque?

It is within the CC companies right to offset any loans in default using the money reclaimed. Though it is possible to negotiate how the payment is made, I wouldn't expect MBNA to be too beneficent given the circumstances,
