All the posts here seem to be about current accounts. I have claimed £900 and £500 (inc interest) respectively against the two credit card companies above, and have had £300 and £150 (approx) credited to my accounts.
The explanation for partial payment given is that they have reduced all charges to a fee of £12 from the £20 and upwards that I was originally charged. They are basically saying they believe £12 is a legal charge.
From what I understand and have read, I am quite within my rights to write back threatening court if they dont pay me back the £550 and £350 respectively they still owe me, but I want to verify this first with you knowledgeable lot.
Where I am confused is that I would be happy to accept some charge (I believe somewhere between £.5 and £2 would be OK), so do I still claim for the full amount?

A small, but exclusive, number of us are reclaiming CC late payment charges.
Even the OFT reduced figure of £12 is still "extravagantly" in excess of what it costs them to automatically administer a late payment. All that happens is that the charge gets added to your account. You don't even get a standard letter.
As the CCCs won't say how much it does cost them, then the law has no option other than to regard the entire charge as unlawful.
I fully understand your feelings about claiming in full, which would then impose the true cost of our late payments on every other customer. However, and again, if the CCCs won't say how much this is, how do we know exactly what we should accept?
In the meantime, "the law of the soukh" applies, albeit in reverse: we open the bidding high, they open the bidding low. One does not tell the other in advance what price you would settle on.The acquisition of wealth is no longer the driving force in my life.0 -
hi,i claimed back all my charges from capitol one they told me they would only pay the difference between the 12.00 and the 25.00,but i rejected there offer filled a court form then they paid the full amount,hope this helps.good luck0

OK, potentially stupid question, but if (as per the top of the page) there's no such thing then cool
All throughout these pages, Martin keeps referring to "banks" all the time. On the other hand, there are a couple of mentions above of credit cards. Now I've got a bunch of overdraft (etc) charges I'm already trying to recover relating to my (one) bank account, but my (eight) credit cards have applied far more in charges, over the years...
So, does exactly the same logic, legal argument, and reclaiming opportunity also apply to credit cards as well as bank accounts?

You can claim back late payment fees and/or over limit fees and follow the same step by step guide in Martin's article.0
