  • Well I think the FO is an option for helping with the claims for credit cards BUT they said that they will only request the amount which equals the difference between the OFT ruling of £12 per item charged and the amount the claimant has been charged per item..

    The £12 charge is still excessively excessive!!!

    The FO said that they are able to claim the FULL amount of charges for Banks and Building Societies because, as yet, there has been no ruling.

    So, in my case, as some of my credit cards have already offered me a settlement of my £12 difference plus a tiny bit of interest, then the FO cant help me.. However, they did say that I could write to the credit card companies and state that they have made a slight mistake in the interest calculation and see what result I get.

    I was wondering if anyone could offer some advice please.

    I received an offer from Capital One yesterday for £32 of the £80 that I requested which was for 4 payments of £20. They claimed that because of the decisions made by the Financial Ombudsman they would reduce the 4 payments to £12 and pay me the difference of £32.

    Well actually what they said is that they wanted to improve their services to their customers and decided to reduce their charge fees to make more people join them - :rotfl: yeah right they were forced to do it!!

    Anyway, I just wondered if anyone could suggest going for the whole measly £80 that Capital One can't bear to part with or should I try and be happy with the £32?

    Obviously, it all depends on your circumstances and the amount involved (both in real and percentage terms) but, personally, I regard any part offer or payment as an attempt to take some of the charges from you for a second time!

    The Office of Fair Trading’s figure of £12 is still “extravagantly” higher than the cost of automatically administering a late payment and therefore unlawful. All that happens is that the computer adds the charge to your account. I didn't even get a standard letter.

    Unfortunately, the Financial Ombudsman will only request the difference between the current £12 charge and any older and higher charges so is not an alternative to court proceedings for these claims.

    However, claims for relatively small amounts do actually have one big advantage. It is proportionally more cost-effective for them to settle. If they make you have to issue a court claim, it immediately costs them an extra £30 for your court fees.

  • about to start reclaiming overlimit fees and late fees on my halifax credit card

    the earlier fees were charged at £25 and the later ones at the reduced amount of £12.

    should i claim for both amounts (plus statutory interest) ?.

    I'd like to ask if people have managed to reclaim the full amount of charges that they claimed from credit cards rather than just the difference between the original amount charged and the £12 recommended by the OFT.

    I tried to claim back £479.30 from Barclaycard and they automatically refunded me £128 without asking me if I accept this deal or not, as they've done to others on here from what I've read. I then proceeded with court action where, apart from Martin's template, I added one more clause in the end of the Particulars of Claim:

    'The Claimant has contacted the Defendant in order to reclaim the default charges but the Defendant has agreed to credit the account of the Claimant only with £2128, which is the difference between the charges incurred and the £12 fee recommended by the Office of Fair Trading. However, the OFT fee is only a recommendation and not a ruling and the default charges apply still constitute a disproportionate penalty. The Claimant therefore asks the court to enter judgment in their favour for the difference of 351.30


    I'm no lawyer so I don't know if I've written something wrong there, I hope not, but I thought I'd take the chance anyway. Barclaycard is defending the case, I've sent back the courts and waiting for a date at the moment.

    At the same time, I've been trying to reclaim £529 from NatWest credit card. Today I received a letter from them where they're offering me the difference again - £152.64.

    My question is: am I proceeding the same way as with Barclaycard? Are there people who have managed to claim back the full amount of credit card charges and not just the difference between the charges and the £12 fee?

    Have had the same trouble with Nat West credit card, so I have sent a complaint to the financial ombudsman to see what they can do if anything. It can't hurt, and will decide on whether to go to court after i receive a response from them. Anyway, don't know about you, but when I got my 'offer' this was supposed to be the difference from the original cost to what is now the norm £12 and was supposed to include any associated interest, but when I did the necessary calculations I couldn't work out what hat they had pulled that figure from, cos it didn't match anything I worked out. But I'll have to wait and see and will post if I get a result. Good luck.

    Yes. Me. And lots of others.

    You can use the bank charge letter templates with a little bit of customisation. The credit card companies will try to use the OFT ruling as justification that the charges as correct, though.

    Unfortunately, the Financial Ombudsman will only request the difference between the current £12 charge and any older and higher charges so is not an alternative to court proceedings for these claims.
