    Useful info', although it's a pity that the FO isn't an option for reclaiming the CC late payments, including the still excessive and unlawful £12 ones, in full.


    Are you sure the Financial Ombudsman only asks for the difference between £12 and the charge? In Martin's guide, 'Going to the Ombudsman' section (http://www.moneysavingexpert.com/reclaim/bank-charges#fos), it states:

    "...in the case of credit cards continue to ask for the full refund and not just the difference between what you were charged and £12 guide price form the OFT."

    I've just sent off an Ombudsman complaint form for a Nationwide credit card, so I'll see what happens. I've asked for the full amount plus 8% interest.

    It would be interesting to know if anyone else has tried the FO route for credit cards and what was the outcome??

    After successfully claiming back my bank charges i have decided to claim back my credit card charges however this isnt turning out as easy. I have wrote to them with the template letters as advised and received some pretty crappy offers back therefore not accepting. The thing is now their 14 days is up from the LBA and i need to file my MCOL however i have just checked the charges and each of my claims is going to cost me £80! Thats £320 altogether which i really really cant afford to pay right now.

    Has anybody got any suggestions on what i can do now i really dont want them to get away with it and want my money back :mad:

    Going to try and sell some things on ebay to raise some money but apart from that im stuck so any advice would be great thanks :)

    You could try the Financial Ombudsman, their help is free. Please read up about it in Martin's article - and you will need to give the bank more time to settle this before you can go down that route.

    I have been advised, by someone who referred a credit card late payment charge claim to them, that the Financial Ombudsman will only request the difference between the current £12 charge and any older and higher charges.

    If you threaten to refer your claim to the Financial Ombudsman, give them until 8 weeks from the date of your first letter to reply. However, if the reply either suggests that you now refer your claim to the Financial Ombudsman or says a definite no, then you can refer your claim to the Financial Ombudsman straight away. If you have not received any reply for the 8 weeks, then you can refer your claim to the Financial Ombudsman.

    Why are you planning on doing all four at once? Do one, then use your winnings to fund the next one, etc.
    The acquisition of wealth is no longer the driving force in my life. :)

    I thought the FO would do that. I am going to have to do one at a time but havent got the spare £80 at the moment hopefully will have soon though with some money making off ebay the thing about using the winnings though doesnt quite apply to me as i have a feeling they will just credit the account and take it off the balance seeing as i owe them and am on a reduced payment plan.

    Are all the card with different companies?

    Some cards are run by the same company such as Capital One and MBNA administering for other banks and store cards. If so you could roll all the Capital One's up into 1 claim and the MBNA's into another. How ever this can cost more later as any single claim over £1,500 may incure a £100 court charge later but the bank will have to pay you back ;)

    Alternatively claim 1 at a time, or give them another 7 days! Tell them if they do not settle up in 7 days YOU WILL take them to court! But you must stick to your time-table, don't let them bully you. This tactic worked with I.F. for me ;)

    Thanks i'll write to them again when i have the money to proceed with the first claim. My claims are with the companies on my signature MBNA, Barclays, Halifax and Capital One. I couldnt believe the cheek of them when they offered me about £80 they can sod off once i have the money im claiming it all back!

    you need to change the wording slightly from..
